TSC Teachers CBA: The Teachers Service Commission, TSC appears to have won a bitter battle against teachers that had drawn the much-needed attention of the Salaries and Remuneration Commission, SRC.

This win sounds a warning to  members of the Kenya National Union of Teachers (Knut) who will continue to miss out on the lucrative Sh. 54 billion pay deal, promotions and other subsequent salary increments.

This is after the Salaries and Remuneration Commission (SRC) dismissed all union claims tabled before it, hence taking sides with the TSC.

TSC Double payroll 

According to the SRC investigations report, it was found that the TSC does not run an illegal double payroll as it had been alleged by KNUT.

TSC has one payroll which it implements with the technical support of Integrated Payroll and Personnel Database (IPPD),” the SRC audit report said.

The report further stated that TSC rightfully implemented the Collective Bargaining Agreement (CBA), the job evaluation report and the Career Progression Guidelines (CPG).

Career Progression Guidelines, CPGs

According to a related report that appeared in the Saturday Standard, at the centre of the dispute between TSC and Knut has been a ruling by the labour court, which set aside the contested Career Progression Guidelines (CPG), which were introduced by teachers’ employer to guide promotions.

“Knut opposed the new guidelines introduced by TSC, demanding promotions be based on merit, seniority, vacancies, academic and professional qualifications. The consequences of the ruling were that all Knut members, who declined the CPG, were locked out of the lucrative Collective Bargaining Agreement (CBA), pushing some of them out of the union. The matter has seen Knut members drop from 187,471 in June last year to 51, 215 last month with revenue dipping from Sh. 144 million to a paltry Sh. 37 million,” the report said

Apparently, Knut had also claimed that the TSC had set up a desk at the head office where members were manually exited from the union, most of the time even without teachers’ consent.

“Knut also insists that TSC used digital validation process to attack its membership register and also used the CBA as dangling carrot to push teachers out of the union,” the report in the Standard said.

“The salaries agency found that teachers exit a union from time to time and absolved the TSC from allegations of Knut that the employer deliberately tampered with union register. These key findings that have given TSC a clean bill of health are likely to further complicate matters for Knut members, which SRC says may not benefit from the lucrative salaries deal until the court matter is settled,” the report further said.

On its part, the SRC report said that the TSC complied with the court order by implementing CPG guidelines for Kenya Union of Post Primary Education Teachers (Kuppet), Kenya Union of Special Needs Education Teachers (Kusnet) and all non unionisable staff and schemes of service for Knut. It added that while implementing the CBA, TSC retained the existing number of salary points or notches at an increasing rate-automatic annual increment as a percentage of basic salary.

“The majority of staff in Grade B5 are due for automatic promotion to C1 in July 2020 in line with CPG,” the report said. TSC Teachers CBA.

Knut wants creation of Comprehensive Schools run by Headteachers

The Kenya National Union of Teachers (Knut) wants the creation of Comprehensive schools to be done immediately. The Teachers’ Union has appealed to Members of Parliament to pass the Sessional Paper Number 10 of 2024 in order to help fix challenges that the basic education sector faces before the transition to senior school in 2026.

 

The union wants the policy document, which has been gathering dust at the Ministry of Education since last year, passed to legally create comprehensive schools that run from Pre-primary to Grade Nine and under one school head. Knut hopes this will cure reported tensions that cropped up after junior school was domiciled in primary schools under the head teachers who managed primary schools.

 

Kenya does not have teachers specifically trained for junior school and those deployed there are for secondary schools. Before the segment was taken to primary schools, it was referred to as junior secondary school. If passed, the policy will make powerful head teachers manning primary schools from pre-primary to Grade 9.

 

“To strengthen curriculum implementation in Basic Education, the government will adopt a 2-6-3-3-3 Education Structure and establish a comprehensive school system where all levels of learning from pre-primary to grade nine are managed as one institution under one head of institution,” the policy document reads in part.

 

Knut’s national deputy chairperson, Malel Langat, said the sessional paper is crucial for reforms in the education sector. He said passage of the sessional paper will bring to an end squabbles between junior school teachers and the head teachers.

 

Also at stake is the fate of the 46,000 junior school teachers who are currently affiliated to and pay agency fees to the Kenya Union of Post-Primary Education Teachers (Kuppet) but who are also claimed by Knut.

“We urge all the MPs to hasten the passage of the Sessional Paper Number 10 of 2024 to help teachers and reform the sector because it was informed by the recommendations from the Presidential Working Party on Education Reforms,” Dr Langat said.

The dispute on Juniour School Teachers highlights a growing rivalry between the two unions over membership and the associated revenue.

KNUT claims that the Junior School teachers, who are now under permanent and pensionable terms after two years of internship, belong to them by virtue of their posting in primary schools.

The union’s secretary-general, Collins Oyuu, maintained that the teachers should not be under KUPPET’s jurisdiction, as they are stationed in primary institutions, not secondary schools.

“The JS teachers are in primary schools, which fall under Knut’s jurisdiction and not secondary schools, which are our sister union KUPPET’s grounds,” he said.

According to Oyuu, the Teachers Service Commission (TSC) has been deducting agency fees from the JS teachers and remitting them to KUPPET, an action he criticised as unfair. He alleged that TSC’s actions were intended to create division between the two unions.

“We are currently driven by the Presidential Working Party on Education Reforms, and the recommendation therein has no junior secondary school, but JS. It is a position recognised by the government. The JS teachers are in the primary section, and fall under the purview of KNUT,” Oyuu stated.

The policy is also expected to further expand the role of head teachers mandating them to take charge of pre-primary up to Grade 9.

 

The competency-based curriculum (CBC) was rolled out in 2019 through a phase-out and phase-in strategy of the 8-4-4 and 2-6-3-3-3 structures. The first cohort of the CBC is currently in Grade 9 and will transition to senior school next year.

Proprietors of private schools, through the chairperson of the Kenya Association of Private Schools Charles Ochome, said they have set up comprehensive schools while some private schools will have standalone senior schools.

 

“Many parents would want stand-alone senior. But we have comprehensive schools; those with big land can designate where they can have the pre-school, middle school, JS and SS,” he said.

 

Recently, Knut Secretary-General Collins Oyuu urged junior school teachers to work in harmony with their colleagues from the primary section.

 

“We are telling our young men and women teaching in junior school, which is domiciled in primary schools, that a teacher is a teacher. Do not think that another teacher is inferior to the other,” he said.

 

Mr Oyuu told the teachers to have proper relationships with the Kenya Primary Schools Heads Association.

 

“These are the teachers manning ECDE, primary, and junior school, which are comprehensive schools,” he said, adding that the heads of institutions should be remunerated differently from their current salaries to reflect their added responsibilities.

 

The Sessional Paper addressed, among others, access, relevance, equity and quality, governance and financing as well as experience in the implementation of Competency Based Education (CBE).

 

According to the Sessional Paper, the number of pre-primary schools increased from 41,779 in 2017 to 46,652 in 2022, while that of primary schools increased from 30,354 to 31,464. The number of secondary schools recorded a growth from 8,958 to 10,390.

 

During the same time, the Gross Enrolment Ratio (GER) for pre-primary improved from 77.1 percent to 111.2 percent. In secondary education, gross enrolment grew from 1.9 million to 3.9 million.

 

At the primary education level, the Pupil-Teacher Ratio (PTR) was 41 for public schools and 24 for private schools. At the secondary level, public schools had a pupil-teacher ratio of 29 compared to 14 in private schools.

 

The policy further states that the government will review the curriculum to rationalise the learning areas, and curriculum designs in tandem with local, regional and international trends.

 

The State will also review the categorisation of public secondary schools and provide for the selection and placement of learners into career pathways in Senior School, and promote equitable access to schooling and learning.

 

Once passed, the policy will mandate the government to review and implement capitation grants at all levels of basic education institutions, and establish a Minimum Essential Package (MEP) capitation for Basic Education institutions, and enhance national and county government consultations on financing pre-primary education.

 

Other gains include strengthening fiscal management and audit function in basic education institutions; developing and implementing a framework to regulate the acquisition of school uniforms in basic education institutions; developing a legal framework to streamline the management and coordination of scholarships and bursaries; developing a framework for resource allocation, resource sharing and stakeholder participation in learning.

On its part, Kenya Union of Post Primary Education Teachers (KUPPET) wants the Juniour Schools to be run by Secondary School Teachers and even moved to Senior School Level (current secondary schools).

Oyuu further insisted that the Labour Relations Act clearly outlines that union membership is voluntary and requires filling out a membership form, which he said the JS teachers had not done in favour of KUPPET.

“The law is very clear on the membership of a trade union by teachers. The Labour Relations Act states that one becomes a member of a union by filling a membership form, which has not happened in the current case,” he said.

He explained that membership should be determined by where a teacher’s services are based, reinforcing Knut’s position.

“The constituency of a union’s membership is based on where one’s services are domiciled. If your services are domiciled in primary school, you are a member of KNUT, and if you are in secondary, you are a member of the KUPPET,” Oyuu added.

Meanwhile, Section 49 of the Labour Relations Act states that workers who benefit from a Collective Bargaining Agreement (CBA) negotiated by a union are required to pay agency fees, even if they are not union members.

TSC News Today; Teachers Service Commission wants Bachelor Education (BEd) degrees, for arts and sciences, abolished and high school teachers undertake a Bachelor of Arts (BA0 or Bachelor of Science (BSc) degree and enrol for a one-year post-graduate diploma (PGD) in Education.

 

 

Article 237(3) of the Constitution gives TSC the mandate to review the standards of education and training of persons entering the teaching service; review the demand for and the supply of teachers; and advise the national government on matters relating to the teaching profession.

 

At the 1st Teachers Conference at Kenya School of Government (KSG) in 2019, I presented a paper (an excerpt from my PhD thesis) proposing harmonisation of the classroom practice by establishing the Kenya School of Education. Our teachers are trained by 68 registered universities in Kenya and others abroad. Their classroom practice is as varied as the universities where they graduated. Other professions do so through post-graduate training. Examples include Kenya School of Revenue Administration (Kesra), Kenya Revenue Authority’s premier training school; Kenya School of Law, for lawyers to join the Bar; and KSG for civil servants.

TSC wants university graduates aspiring to be teachers to undergo a post-graduate diploma in education. It has begun a transformative agenda that will see the framework for entry to the teaching service revised. All the 8-4-4 and Competency-Based Curriculum (CBC) students must undertake, first, BA or BSc for three years, majoring in the key subjects, and then a year-long postgraduate diploma in education for them to teach at junior, senior school and Special Needs Education (SNE).

 

I am against Universities’ Academic Staff Union (Uasu) opposition to this proposal. TSC is the greatest (constitutionally mandated) consumer of trained teachers. Ordinarily, it is the consumer who ultimately determines which goods and services remain in production. If they want the BEd programme replaced with BA and BSc, so be it. A graduate who wants to teach will do the Education PGD. BA or BSc students spend equal time at the university with their Bachelor of Education (BEd) peers.

 

 

In Finland, teachers are required to have a master’s degree, including pedagogical studies and teaching practice. TSC Replacement Vacancies 2022

Teachers Service Commission announced 2,945 vacancies to replace teachers exiting the teaching service through natural attrition.

 

Of the total number,2,053 teachers will fill vacant positions left in primary schools while 892 tutors will be posted in secondary schools across the country. The teachers will serve on permanent and pensionable terms.

 

 

 

In the February 2022 recruitment TSC clarified that primary school teachers will not apply for the replacement vacancies through the online platform but will be selected from the merit list compiled during the recruitment of additional teachers in July 2021.

 

 

 

 

“In the January 2022 advertisement on natural attrition, primary school teachers will be selected from the merit list compiled during the recruitment of additional teachers – July 2021,” read the statement.

 

 

 

 

 

This therefore leaves TSC registered but unemployed secondary school teachers on crossroads on the criteria the Commission will use to select teachers who will fill the few vacancies.

 

 

 

 

 

According to the recruitment roadmap, TSC county directors collected employment from the commission on Friday,28th January .The commission is expected to generate a merit list by the end of week which will be worked upon by recruitment panels in schools where Recruitment will take place between Friday 11th February and Thursday 17th February 2022.

 

 

 

There is no doubt that the following considerations ,guidelines and scoresheet will be applied in generating merit lists in the upcoming recruitment exercise

 

In the new recruitment guidelines released by TSC, qualified teachers who have evidence of internship will stand high chances of securing TSC jobs.

 

 

 

 

 

Another factor that will increase chances of one to get employed is the quality of certificate. However, tutors teaching subjects combinations like:

Biology/Agriculture

Chemistry/Biology

are easily absorbed by TSC since they are few.

Details have emerged that the Competency-Based Assessment (CBA) will save the government billions of shillings in examination printing, administration, and management. This follows a departure from the outdated KCPE ( Kenya Certificate Of Primary Education) where KNEC contracted teachers to mark English Composition and Kiswahili Insha papers. It is confirmed that there are no such papers in the new CBC Evaluation system.

The Kenya National Examinations Council (KNEC) has availed samples of the upcoming grade six national examinations which exhibit that Composition and Insha will not be tested/examined. Consequently, teachers will not be involved in marking the final national exams in primary school as has been the norm with the former KCPE.

This translates to KNEC cutting down the high cost of examination management when the Competency-Based Assessments fully roll out in the grade 6 national examination class.  This is because the incoming CBC’S KAPSEA national Examination will be purely in multiple-choice questions that will easily be marked using the new technology.

HOW OMR MACHINE WORKS

It is important to note that in last year’s KCPE Exams, the marking of multiple-choice questions was made easier when the Council-KNEC- acquired the Modern Optical Mark Recognition( OMR) which electronically scored the papers. This OMR machine marks the candidates’ work by capturing marked data from the candidates’ answer sheets using specialized scanning. These machines worked with a dedicated scanning device that shined a beam of light on the candidates’ work/paper. Then the contrasting reflection at predetermined positions on a page is used to detect marked areas as they reflect less light than the blank areas of the paper. A great departure from the previous year’s marking that took hours, these new machines marked the candidates’ scripts in bunches of 100 and 200 sheets thus taking the shortest time on record.

In these assessments, KNEC only provided online copies which schools downloaded and printed for their learners to have a feel of what the national examination will be like later in the year. It is also important to note that the teachers also helped in marking, scoring, recording, and feeding the final marks on online KNEC portals thus enabling the Exam council to evade direct costs that come with national examination administration.

Grade six learners will sit for their final test in primary school that will be known as KENYA PRIMARY SCHOOL EDUCATION ASSESSMENT (KPSEA) in November this year. This national exam will start on the 28th and run to 30th November 2022. The CS Education, Professor Magoha has assured all the stakeholders that the exam has already been printed and that it is just awaiting administration when the time comes!

KNEC Competency-Based Assessment Coordinator madam Ann Ngatia explained that Integrated and Creative Sciences will be an integration of various subjects and that the five will be part of the kpsea at the end of primary school.

” The exam will be a multiple-choice test covering the five papers. Integrated Science will see us combine Science and technology and will cover Home Science, Agriculture, and Physical Health while Creative Arts and Social Studies will combine Aert and Craft, Music, Social Studies, and Religious Education( CRE, IRE, and HRE),”  Madam Ngatia observed. She also added that the primary school results would be determined by what has come commonly to be referred to as the School-Based Assessment (SBA), which is done every year in the upper primary classes.

-A yeast infection disease which affects the mouth

-It is caused by the fungus Candida Albicans. This yeast builds up in the mouth forming white or yellow-like bumps on the inner part of the cheeks, tongues and sometimes tonsils.

How to Select Grade 10 Subjects and schools

To select Grade 10 schools and subjects under the Competency-Based Curriculum (CBC) in Kenya, Grade 9 learners should first choose a career pathway (STEM, Social Sciences, or Arts & Sports Science). Then, they’ll select three subject combinations within that pathway and finally, choose four schools for each combination, totaling 12 schools. To select preferred Grade 10 Schools and Subject Combinations, use the Ministry of Education portal selection.education.go.ke.

1. How you can Choose a Career Pathway:

  • Identify your interests and potential career aspirations.
  • Select one of the three pathways: STEM, Social Sciences, or Arts & Sports Science.
  • Confirm your choice to proceed with the pathway.

2. Select Subject Combinations:

  • The portal will provide you with a list of subject combinations available within your chosen pathway.
  • Choose three subject combinations that align with your interests and strengths.

3. Select Preferred Senior Schools:

  • For each subject combination, select four schools from the available clusters.
  • This ensures a diverse range of options and equal representation from different categories of schools.
  • A total of 12 schools will be selected: 4 for the first subject combination, 4 for the second, and 4 for the third.

TSC :Revised Top Salary Scale/Payslip & Allowances For A newly Employed Teacher Per Month as From February 2023

Any professional secondary school teacher who is newly employed by Teachers Service Commission (TSC)in Kenya falls under job group K which is the starting point that is currently referred to as grade C2 also classified as Secondary Teacher II.

 

After a teacher is absorbed by TSC, he/ she receives an appointment letter that always states that a newly employed teacher remains on probation for a period of not less than six (6) months. However, there comes a scenario when the probation period may be extended if the teacher’s performance is not satisfactory.

 

 

 

Once a teacher serves for a duration of 3 years, he/she is automatically promoted grade C3, previously known as job group L.

 

According to Tsc, the minimum requirements for one to teach in secondary school is diploma but nowadays majority of secondary school teachers are university graduates.

 

For the newly Employed teachers under (grade C2 ) initially known as job group K the teacher enjoys commuter allowance of KSH 5000 and rental house allowance of KSH 7500.

 

 

 

Then the graduate teacher can now carry home a total amount of KSH.38000 .This figure though changes if one used to benefit from HELB loan since some amount is deducted.

 

 

 

The breakdown of the salary for a newly employed graduate teacher in a secondary school is given below:

 

1 .Basic Salary ksh.34,955

 

2 . House Allowance ksh 7,500

 

3 .Commuter Allowance ksh. 5,000.

 

4 .Total Earnings (before deductions) KSH 47,455.

 

 

Mandatory Deductions for TSC Teachers

Teachers note that there are other several deductions subjected to salary of a newly employed teacher. They deductions include:

 

 

 

-Children’ and widow’s Pension Scheme which is about Kshs. 699.10.

 

– the University Loan Recovery of about Kshs. 5000.

 

The above deduction on HElB only affect those teachers who benefitted .

 

Other deductions include those made to teachers’unions such as KNUT and KUPPET, KEWOTA, PAYE plus sacco savings,PAYE, NHIF,

The lowest earner in this group gets a salary of Sh131,380 while the highest earner in this group earns Sh157,656 per month.

In the new recruitment guidelines released by TSC for the September 2020 recruitment, some factors will be considered before one is employed.

Teachers who have undertaken masters degree, length of stay since the year of graduation and some other factors will be looked at.

Those who are willing to apply have to present Original and legible Photocopies of the following essential documents:

National identification cards;
National Council of Persons with Disability (NCPWD) Card (where applicable);
KCPE Certificates;
KCSE Certificates (include first attempt certificate if repeated exams);
Diploma/Degree Certificates and official transcripts;
Primary and Secondary Schools leaving certificates
NB: Provisional transcript shall not be accepted.
Where names on the submitted documents differ, the applicant will be required to submit a sworn affidavit.

It is important to note that teachers who are serving in internship programme will have an advantage of ten(10) marks. This will automatically give them an upper hand.

One who has a co-curricular certificate of participation will also stand higher chances of scoring more marks. This part is very crucial when it comes to breaking of ties.

How to Check Grade 10 Selection Choices

The Grade 10 School and Career Pathway Selection System is a national digital platform developed to assist Grade 9 learners in making informed decisions as they transition to Senior School. The platform enables students to select their preferred Pathways, Subject Combinations & Senior Schools in line with Kenya’s Competency-Based Education (CBE) framework.
The goal is to empower learners to take control of their educational journey by aligning their selections with their individual talents, interests, and aspirations.

 

The platform is used to place learners who have completed Grade 9 into appropriate senior secondary schools based on their performance, interests, and chosen career pathways under the Competency-Based Education Curriculum (CBC/ CBE) in Kenya.

How to Select Grade 10 Subjects and schools

To select Grade 10 schools and subjects under the Competency-Based Curriculum (CBC) in Kenya, Grade 9 learners should first choose a career pathway (STEM, Social Sciences, or Arts & Sports Science). Then, they’ll select three subject combinations within that pathway and finally, choose four schools for each combination, totaling 12 schools. To select preferred Grade 10 Schools and Subject Combinations, use the Ministry of Education portal selection.education.go.ke.

1. How you can Choose a Career Pathway:

  • Identify your interests and potential career aspirations.
  • Select one of the three pathways: STEM, Social Sciences, or Arts & Sports Science.
  • Confirm your choice to proceed with the pathway.

2. Select Subject Combinations:

  • The portal will provide you with a list of subject combinations available within your chosen pathway.
  • Choose three subject combinations that align with your interests and strengths.

3. Select Preferred Senior Schools:

  • For each subject combination, select four schools from the available clusters.
  • This ensures a diverse range of options and equal representation from different categories of schools.
  • A total of 12 schools will be selected: 4 for the first subject combination, 4 for the second, and 4 for the third.

SELECTION OF PATHWAYS AND SENIOR SCHOOLS

• Determination of pathways per senior school
• Determination of vacancies for boarding and day schooling in senior schools
• Selection of pathways, subjects’ combination and schools by grade 9 learners Selection based on pathway

The learner will select 12 schools for their chosen pathway as follows.
– Four 4 schools in first choice track and subject combination
– Four (4) schools in second choice subject combination
– Four (4) schools in third choice subject combination (Total 12 schools) Selection based on accommodation

Out of the 12 schools selected based on pathway;

  • 9 will be boarding schools; 3 from the learners’ home county, 6 from outside their home county/county of residence.
  • Three (3) day schools in their home sub county/sub county of residence. (Total 12 schools)
    Pre selection – A school that does not allow open placement can apply to be pre-select if it meets the criteria defined by the Ministry of Education.

How Placement of learners to Senior Schools (SS) at Grade 10 will be done

It will be based on:

  • Top 6 learners per gender in each STEM track per sub-county will be placed for Boarding in  schools of choice
  • Top 3 learners per gender in each Social Science track per sub-county will be placed for Boarding in schools of choice
  • Top 2 learners per gender in each Arts and Sports Science track per sub-county be placed to Boarding schools of their choice
  • Placement of Candidates with Achievement Level of averaging 7 and 8 per track to boarding schools of their choice

Admission and replacement process

  • Placement results will show where learners have been placed
  • Admission letters/joining instructions shall be accessed online using the learner’s assessment Number.
  • All schools, both public and private shall admit Grade 10 through KEMIS
  • Leaners will be entered to the KEMIS System only after reporting physically to the school.
  •  Daily online reporting shall be monitored through KEMIS

Replacements

  •  Schools with vacancies will declare through their respective county directors of education
  •  Learners who wish to change schools will make requests through the heads of junior schools at least 2 weeks before the official grade 10 reporting date
  • Priority shall be given to those who had earlier selected the schools they are requesting for  Approvals by MoE shall be based on senior schools’ documented capacity
  • Upon a request’s approval, the joining instructions shall be accessed online; at no time shall a school issue printed letters for replacement cases
  • Replacement will be done once and shall be irreversible
