The fate of 44,000 teachers recruited by the Teachers Service Commission (TSC) hangs in the balance after the employer told Parliament that it may terminate their employment if the National Treasury does not allocate funds following a recent Court of Appeal ruling.

The teachers are majorly deployed in junior schools and such a move would leave the schools grossly under-staffed and affect learning in the segment that comprises Grade 7, 8 and 9 under the Competency-Based Education (CBE).

The TSC legal director Cavin Anyuor told the National Assembly Committee on Education that the commission only has the option of employing the teachers on permanent and pensionable terms or terminate their employment after the court declared the teacher internship programme discriminatory, unconstitutional, and illegal.

The ruling was delivered on February 27, 2026. The Court of Appeal upheld an earlier decision by the Employment and Labour Relations Court declaring the TSC internship programme policy null and void. The intervention comes at a time when the interns renewed their contracts for another year, running from January 1, 2026, to December 31, 2026.

“We are in court seeking a grace period to allow the government to organise itself, mobilise the necessary resources, and set clear timelines for implementation before pronouncing itself on the matter. We hope the court will grant us that grace period,” said Mr Anyuor when senior officials of the commission appeared before the National Assembly Committee on Education yesterday.

The commission introduced the programme in 2019 to plug staffing gaps in the service. The Kenya Kwanza regime has touted its mass teacher recruitment programme as one of its successes, but that would now change if the teachers are not converted to permanent and pensionable.

The teachers and teachers’ unions have termed the programme an abuse of labour since the teachers are paid a ‘stipend’ instead of a salary and do not enjoy all the other benefits other teachers enjoy.

The latest cohort of intern teachers, comprising 24,000 most of whom were posted to junior schools, was engaged in January this year, surpassing the TSC’s initial target of 20,000. The January recruitment largely focused on hiring science teachers, as the government sought to address an acute shortage of technical teachers in junior schools.

Mr Anyuor told the MPs that due to the profound effect of the court ruling, the commission has held a crisis meeting and that engagements to chart a way forward are at an advanced stage.

“The commission has also engaged with the government to chart the way forward to either take one of the options,” he said.

More Funds Needed

The chair of the committee, Julius Melly urged the TSC not to discontinue the internship programme, warning that doing so would render thousands of young Kenyans jobless and worsen inflationary pressures.

“The best thing you can do is to impress on the National Treasury for additional funding,” he said during consideration of the Supplementary Estimates 1 for the financial year 2025/2026.

Last week, Education Cabinet Secretary Julius Ogamba told the Senate that the government intends to abide by the Court of Appeal decision, which rendered the teacher internship policy null and void.

“The court was unequivocal that recruiting trained and registered teachers as interns is illegal and discriminatory. What is the Ministry doing to ensure these teachers are absorbed on permanent and pensionable terms,” said Mr Ogamba. He was responding to Kitui Senator Enoch Wambua who raised concerns regarding the status of the educators.

“The Court of Appeal has determined that the policy of internship for teachers is null and void. As we speak, the TSC and the Ministry are studying the ruling to determine the steps required to ensure full compliance. We recognise there will be significant financial and budgetary implications,” the CS stated.

While the CS did not provide immediate timelines, he assured the House that the extent of the legal and financial burden is being calculated to allow for a smooth transition to the TSC payroll.

However, Nandi Senator Samson Cherargei, accused the CS of being cagy regarding the exact costs of the absorption.

“The CS cannot say he wants to comply without telling us if they have requested funds in the supplementary budget. We need to know how much is required and how the transition will happen to ensure it is not done through political favoritism or discrimination,” Mr Cherargei argued.

About a fortnight ago, the Kenya Union of Post Primary Education Teachers (Kuppet) warned that it would leverage legal instruments regarding the continued engagement of 44,000 intern teachers by TSC without confirmation.

Kuppet Secretary-General Akelo Misosi said it was unacceptable for the commission to engage the teachers as interns when they are registered professionals.

“We are giving TSC an ultimatum to style up, because soon we will adopt the legal framework to address this issue,” Mr Misori said.

1. Application must be made on the official loan form, fully completed and appropriately signed by both the loanee and guarantors in their own handwriting.
2. The applicant is required to attach the latest original payslip (not more than one month old at the date of application).
3. Loans are granted in accordance with the loan policy and lending conditions existing at the time of application.
4. For a member to qualify for loan consideration, he/she must have contributed shares for a minimum period of three months, subject to the policy in force.
5. Any amount of money deposited by a member, either in cash or by cheque, to boost shares shall wait for six months before that amount can be used to secure a loan.
6. A member whose share contributions have fallen off the payroll but has continued repaying his/her loan and is in need of a new loan will be required to update his/her shares account by repaying in cash or authorising an offset from the loan of an equivalent amount of the arrears.
7. Any member who clears his/her loans by cash/cheque must wait for one month before qualifying for loan consideration, subject to the policy in force. A member whose loan is cleared through Front Office Service Activity (FOSA) will qualify for loan consideration immediately under clearance conditions. For members whose loans shall be bridged through FOSA, the loan being processed shall be credited to the FOSA account.
8. Guarantors, who must be members of the Society, shall not guarantee more than eight major loans (Normal, Development, Super, and Vision).

9. The type of loan applied for shall be stated with reference to Clause 2.10 on page 2.

10. The interest rates shall be determined by the Board of Directors from time to time.
11. Vision loan will attract a processing fee of 1% of the amount approved and recovered up-front
12. The amount applied for shall be fully covered by the loanees plus guarantor’s shares
13. Minimum monthly deposits contribution for those with loans shall be determined by the share banding on the amount approved
14. A dormant member shall not be considered for any loan.
15. Minimum monthly deposits contribution for members without loans will be Kshs. 1000.00 per month subject to change from time to time.
16. No member will be allowed to suffer deductions including loan repayment in excess of two thirds of the basic salary.
17. Members can take a second loan other than emergency/school Fees in addition to an existing loan without necessarily clearing the outstanding loan subject to ability
18. Loans shall only be paid to member’s FOSA account
19. If a member decides to cancel his/her loan after the process has been finalised a fee of Kshs. 2,000/= shall be charged.
20. Any alteration on the loan form may cause disqualification.
21. It is a big win for Juniour School Teachers in their push for autonomy. This is after the Teachers Service Commission (TSC) proposed an independent junior school structure and management. This is contrary to the directive by the Ministry of Education, MOE.

As the Ministry proposes to merge the institution with the primary school to form one comprehensive school, TSC has taken a different path arguing that will be detrimental.

The Commission has proposed establishment of independent governance and administrative structure for junior schools.

The proposals which were presented to Parliament before the National Assembly Committee on Education, will see junior schools break away from joint leadership with primary schools, giving junior school teachers a major win in their quest for autonomy.

The proposals come after President William Ruto briefly met some junior school teachers during national exam marking exercise last year and promised to address the junior school autonomy issue.

“I have heard you and I think you have a point. I will have a talk with the Teachers Service Commission, which is an independent institution on what they are going to do,” said Ruto after he briefly met teachers stationed at State House Girls High School for KJSEA marking exercise who had pushed him to declare junior school independent.

Under the new structure junior schools which comprise of Grades 7, 8 and 9 would operate independently, no longer under primary school heads who have managed this section for the past three years.

This is a blow to primary school headteachers who have served as Principals of junior schools in acting capacity and who have been pushing for their confirmation.

The headteachers were looking forward for adoption of the proposal by the Ministry of Education that would make primary and junior school one institution headed by one principal and two deputy principal (one for primary and another for junior) which would have opened an opportunity for their confirmation and promotion to job group D1.

These latest reforms by TSC would allow junior schools to appoint substantive principals and deputy principals, creating a need for additional salaries, benefits, and administrative resources.

Appearing before the Committee, TSC Acting Chief Executive Officer Evelyne Mitei said the move is intended to strengthen leadership, accountability, and service delivery in junior schools, which are currently managed jointly with primary schools.

Mitei told MPs that the change would require increased budget allocations for personnel emoluments to sustain the new leadership positions.

“In a bid to streghten leadership and governance in junior schools, there is a proposed policy change to provide a new administrative structure,” Mitei stated.

She added that the reforms are necessary to support effective curriculum implementation and ensure proper succession management within schools.

TSC indicated that newly deployed administrators would require extensive training and capacity building to manage the institutions effectively.

Junior school teachers have been accusing primary headteachers of mismanagement of junior school resources and high handedness in management.

Some of the teachers have previously accused primary headteachers of using junior school funds to equip primary schools.

Most junior school teachers are uncomfortable with junior schools being headed by primary headteachers, who they say are incompetent and are less educated.

The autonomy push by junior school seem to be a success after Mitei sudden changes.

Initially TSC had planned to upgrade P1 teachers through a World Bank sponsored programme so they could handle junior school classes under comprehensive school model.

The programme was later abandoned as the Commission now unveils how junior schools will be managed going forward.

Last year the Kenya Union of Post Primary Education Teachers (Kuppet) and Kenya Junior School Teachers Association (Kejusta) led calls for autonomy in the management of junior schools.

The two groups argued that granting junior school independence would not only ease administration but also strengthen the Competency Based Education (CBE).

Key Requirements:

• Data must be accurate, complete, current, and verifiable.
• Records shall clearly Indicate: Teacher TSC number and Name, Institution and level, County, Discipline and specific role, position, Level of participation (Sub-County, County, Regional, National, East African).
• Maintain and update the database annually and submit the records to the Commission whenever required.

Note: For any clarification, liaise with the Regional Director – Nalrobi, Dr. Samuel Marigat, who is the designated liaison officer between the Commission and the MOE on co-curricular activities.
