Teachers employed by Teachers Service Commission, TSC are stratified into two major groups: those with administrative responsibilities administrators and those without- non-administrators or regular classroom teachers. The Commission has also come up with thirty-six (36) job titles technically referred to as grades for teachers.

The administrators’ group constitutes Headteachers, Deputy Headteachers, and Senior Teachers in primary schools as well as Principals, Deputy Principals, Senior Masters and Senior Lecturers in post-primary institutions (Secondary and Tertiary).

The remaining job titles comprise of teachers who are non-administrators. It is crucial to note that TSC promotions from a non-administrative grade to an administrative one requires at least three years.

For a teacher to get promoted from one administrative post to the next however, the case is different since such tutors have to be subjected to rigorous assessments through highly competitive interviews given the limited number of administrative posts within learning institutions.

Besides, teachers’ salaries are also pegged in the various grade/ job group. Those with administrative positions are ranked higher compared to regular classroom teachers without administrative responsibilities.

The Teachers Service Commission has directed all schools and teachers to upload their TMIS data onto the official TSC Website.

TMIS data is usually updated on a termly basis in order to capture crucial information on teachers, school details, and learners’ enrollment rate etc.

Schools are therefore expected to adhere to the deadline for uploading TMIS data which has been set on 15th March, 2020.

HOW TO SUCCESSFULLY UPDATE YOUR TMIS DATA

To successfully upload your TMIS data, follow the following simple steps:

  1. Visit the official TSC website by clicking on the following link https://teachersonline.tsc.go.ke/
  2. From the official TSC website home page, click on the tab labelled “ONLINE SERVICES” then select “TEACHERS ONLINE SERVICES”
  3. On the new page, log in using your User Name and Password as captured by the TSC sub county director.
  4. On the next window, click on “TMIS RETURNS” followed by “SUBMIT TEACHER RETURNS.”
  5. Then submit all the correct data on your school on the window labelled “BASIC DETAILS.”
  6. Once you are done, click on “NEXT TO ENROLLMENT.” The next step is to declare the correct “ORDINARY SCHOOL ENROLLMENT” data then select “NEXT TO TEACHERS DETAILS.”
  7. To modify data for every teacher, click on the icon under the “ACTION” column.

This follows a paradigm shift that saw the commission move teachers from the former payslip.tsc.go.ke/ to the new portal at tpay.tsc.go.ke.

Newly recruited teachers who have not yet been registered on the new TPAY system can contact the human resource manager at their respective TSC  County Offices to register.

Kindly note that the commission no longer allows newly employed teachers to register themselves on the Tpay online system following fraudulent activities witnessed. 

TO RESET YOUR T-PAY PASSWORD.

In an event you forget your T-pay password, you have no reasons to be worried. Remember, you can reset your Tpay password by using the simplified steps below;

You access the TPAY portal and click on the “Reset Password” button.

You will then be prompted to enter your TSC number and click on the “Reset
Password “button.

From the “Reset Password “window you will be prompted to enter an “OTP (One Time Password) Code “that they receive via their mobile, “New Password “and confirmation of the password.

Once done with the step above you can now login and access their TPAY account.

NEW MENU INTRODUCED ON THE NEW T-PAY PORTAL

You can now get a number of new items in the T-pay portal. The ‘My Documents’ tab is one of the new menu introduced on the much improved payslips portal.

The new T-pay menu is very user friendly and contains the following menu:

This tab enables a TSC employed teacher to view his or her monthly payslips online. Once you click on it, your most recent Payslip is displayed.

To view your previous TSC payslips:

From the drop-down menu on your left, indicate the year and month for which you would like to access the payslip.

Note that you can only access a single payslip at a time.

The Teachers Service Commission, TSC Head of Communications Beatrice Wababu has reassured teachers not to worry since the Commission will ensure that they receive their final salary increments this month.

According to TSC, the money for the fourth phase of the 2017-2021 CBA has already been budgeted for and will be paid in full; despite the economic hurdles posed by the covid-19 pandemic.

“The fourth phase of CBA implementation comes at the end of this month, July,” she confirmed.

Ms. Wababu also underscored the indispensable role played by the teachers.

“As we await government directives on reopening of schools, the Commission wishes to thank all teachers for the support that they have been accorded us. We value this partnership that has enabled us to continue serving you even under the current circumstances. Further, we value your efforts in engaging your learners online through lessons and words of encouragement. Thank you and please continue reaching out.

The CBA which was first implemented in the year 2017 saw regular classroom teachers-without administrative roles receive their pay rise in the first two phases only while school administrators reaped big with their salary increments being rolled out in four phases.

MUTUAL UNDERSTANDING

Ms. Wababu further described the teaching profession as unique to mean that teaching goes beyond the labor law for it calls for mutual understanding and constant feedback.

“Due to the unique nature of the teaching profession, our relationship goes a step further beyond the labor law. It is one of mutual understanding, relying on constant feedback both ways,” added Ms. Wababu.

She also urged all teachers to maintain the goodwill that the Commission has enjoyed for the past five years for it has enabled the TSC to achieve milestones within the span.

“We rely on you to perform our job better and in turn, you rely on us to provide quality education to the Kenyan child. This goodwill has enabled the Commission to achieve a lot in the last five years. Key among our achievements is the signing of the 2017-2021 Collective Bargaining Agreement, CBA with teachers’ unions.”

SUSPENDED PAY RISE

This announcement comes at a point when teachers were afraid that the Government may consider suspending the salary increments following the spread of the coronavirus that has negatively impacted on the economy.

In Uganda, the government has suspended planned pay rise for civil servants to the year 2023 following the outbreak of coronavirus, floods, and landslides.

“The Government is ready to increase the pay for its servants but in a phased manner. Staff in public universities will get their pay rise in the financial year 2020/2021 but the other civil servants will have to be patient and wait until the year 2022 and 2023,” said Ms. Catherine Bitarakwate, the PS in the Ministry of Service last week.

TSC TEACHERS’ NEW INCREASED SALARIES

Among those whetting their appetite for fatter salaries come the end of July are 100, 000 P1 teachers who are currently categorized in Grade B5 for they will be automatically get promoted to Grade C1.

This automatic promotion is however limited to tutors who were already in the TSC payroll before July 2017.

5, 000 diploma teachers in secondary schools in Grade C1 (Former J) will also get increased salaries.

CS Magoha’s announcement that the government will soon release free education funds to help schools meet costs such as paying BOM staff salaries rekindled the hope of many BOM teachers who had gone without pay for over five months now.

However, the joy seems to have vanished as soon as it had come given the indifference that some BOM teachers have been treated to this week.

As promised by Professor Magoha, the funds did hit the school accounts. If my memory serves me right, part of that cash was meant to pay subordinate staff such as security personnel and teachers employed by school boards of management.

“The government has set aside sufficient funds to pay Board of Management teachers, non-teaching staff including security personnel to ensure proper maintenance and safety in schools,” said  Magoha in a press briefing.

The funds were deposited in school operations accounts between August 3 and 5, 2020. A spot check by our media team shows that no disbursement was made for the tuition account now that learners are not in school.

“All the requisite funds have been released to schools. Therefore, it is expected that the support staff will continue receiving their wages,” confirmed Magoha last week.

The ministry used data in its National Education Management Information System, NEMIS to determine what each school will get.

Every secondary school learner got Sh 3, 725 in the latest disbursement by the education ministry. Ina year, every learner in all public schools receives sh 22, 244 through the free day secondary education. Part of this money, Sh9, 400 is deposited into the school’s operations account which encompasses personal emoluments such as BOM staff salaries.

The disbursement is usually done in the ration 50:30:20 for terms 1, 2, and 3 respectively.

BOM TEACHERS, STAFF BETRAYED IN SALARY DEAL

Now that the free education funds hit the schools’ operations accounts, many embarked on paying salaries to BOM teachers and subordinate staff.

What is shocking is the fact that some schools opted to pay part of the July salaries, writing off unpaid balances.

If the government released full funds, why should schools pay part of the salaries and write off the balances?

One of the teachers whose identity we will not reveal for fear of being victimized revealed the rot in schools. According to him, he earns a monthly salary of sh 14, 000 but the school only deposited Sh 7, 000 into his account.

Attempts by the teacher and our media team to reach the principal to address the matter have been futile.

“My monthly salary is sh 14, 000 but I have only received sh 7, 000.  Attempts to reach the principal have been futile with his phone going unanswered or off,” confessed one of the affected teachers.

HALF SALARIES, UNPAID LEAVE

In another school, BOM teachers have been informed that they will receive half salaries for August after which they will proceed on unpaid leaves till schools reopen.

“Subject to a BOM meeting held on August 4, 2020, it was decided that you will be paid half salary in August 2020. From September 1, 2020, you will proceed on unpaid leave until such a time when the ministry gives further instructions on reopening(dates) of schools,” read part of the school’s memo.

This was expected given the way CS Magoha refused to commit to paying BOM teachers’ salaries. Last week he distanced himself from the matter, saying that it was upon schools to pay their BOM staff since they are not employed by the ministry.

It is therefore not clear whether schools will or should pay all salary arrears owed to BOM staff. To make matters worse, no ministry official is willing to commit to paying the salaries. So where does this leave BOM staff and teachers?

The Teachers Service Commission, TSC has spelt out serious consequences and disciplinary actions for teachers who fail to activate their Microsoft Outlook 365 emails online before the set deadline.

According to the latest circular released by the Commission, the teachers will be barred from Declaring their wealth online as per the Kenyan Constitution Act.

The affected teachers are therefore likely to suffer more given that failure to declare their assets, liabilities and other wealth attracts a penalty not exceeding 100 000 Kenyan shilings or a jail term.

To Declare your wealth;

All Heads of Institutions are required to monitor the progress of the Declarations in their respective institutions and report all cases of non-Compliance as reflected in line with Part B in the Wealth Declaration Instruction Manual by 31st December, 2021.

Any teacher in TSC employment who fails to submit a Declaration or gives false or misleading information is liable to a fine of Kshs. 1,000,000 or imprisonment for a term not exceeding (1) one year or both upon conviction.

All teachers in employment of TSC are required to declare their Income, Assets & Liabilities. These include teachers on:

Interdiction
Suspension
Sick leave
Authorized absence from duty

All TSC employees can be users in the Teachers Online Services Information system. It is a web based system and can be accessed through any browser preferably chrome or Mozilla Firefox.

Access the TSC portal by using the link: www.teachersonline.go.ke
Enter your TSC number and click on ‘Next’.
In the next window, enter your TSC Number and password and click on ‘Login’. In case you forgot your password, click on the ‘Forgot password’ link.
After logging in, check on the ‘Wealth Declaration’ tab at the top of your Window.
From the drop down list, click on ‘Basic Information’. The following information is already preloaded: First Name, Middle Name, Last Name, Phone Number, Email, ID and D.O.B.
Now enter the following: Gender, Place of Birth, Marital Status and Postal details.
Provide your mobile number and VALID e-mail address. Do not use another
person’s e-mail. This is because you will need it for the purposes of:
i. Resetting your password in case you forget it.
ii. Confirmation of declaration submission as a copy will be sent to your email upon completion.
Once done, click on ‘Next’. In section B, enter your approximate income, assets and liabilities.
The next window requires that you input your Dependant’s information (Spouse and Children under the age of 18 years).
You will now be expected to enter the Witness’s details (Names, Address and ID) in order to complete the upload.
Click on the view Summary button to view your declaration. In case you need to
make corrections, click on the appropriate menu on the left side of the window or
use previous button to move back to the page you want to edit. Once you are
satisfied, click on the Submit button to complete your declaration. A copy will be
sent to your e-mail which you provided above.
Resetting password for TSC wealth declaration Portal
In case you forget your password, click on the Forgot password button.
Enter your TSC No then click Continue button to re-set your password. Follow the instructions given in your e-mail to create a new password.
Changing password for TSC wealth declaration Portal
In case your password is compromised and you need to change, click on the drop down Arrow at the top of the right side of the window and click on the Profile menu.
Click on Account
Enter the new password in the New password field and the old password in the Current password field. Click on the Save button to save. Use the new password next time you want to log in.
Note that the system will be activated with effect from 1st October, 2021 to 31st December, 2021 to facilitate online declarations.

Ensure that you have logged out of the system when you are not using it for security reasons. To log out, Click on the drop down Arrow at the top of the right side of the window and click on Sign out.

All tutors in Kenya will be expected to report to their various work stations 14 days before the official schools’ reopening date on September 1, 2020.

According to CS Magoha, it is pertinent that teachers are taken through rigorous training on the various mitigation measures in the event of Covid-19 within their schools.

The CS said this on Wednesday as he was inspecting the sewing of masks meant for learners at the Kitui Textile Industry.

“We will need teachers in school two weeks earlier because they need to be trained on Covid-19,” said CS Magoha.

Testing

The CS also hinted that teachers, who are likely to resume duty in September 2020 may undergo Covid-19 testing to ascertain their status.

This announcement comes even as the education ministry is yet to disclose the fine details of the process especially when it comes to the cost of testing the over 300, 000 tutors currently employed by the TSC, BOM, and Private School teachers.

Employees in other sectors such as the Hotel industry have in the past complained about the high testing cost.

Therefore, the Government needs to clarify on how teachers’ tests will be catered for.

Are Teachers fully covered for Coronavirus by TSC-Contracted MINET-AON insurance?

The next key question that is mindboggling is the safety of teachers in schools even as the ministry plans to reopen schools.

Currently, a teacher in Kenya mans a class of approximately 50-60 learners in primary and secondary schools. If these huge classes are not split as proposed by health experts into clusters of 15-20 learners in a class, then it is obvious that the social distancing rule will not be achieved.

Besides, the CS made it clear in a high-profile summit chaired by His Excellency President Uhuru Kenyatta that it will be unrealistic to expect the government to expand infrastructure within schools to enforce the social distancing rule since it has taken ages to build what is within our vicinity in public schools.

My point is the teachers manning these classes will be exposed to the coronavirus. Therefore, the teachers’ employer, TSC should first liaise with Minet-AON insurance Provider to ensure that teachers are fully covered for Covid-19 before sending them to their “slaughter-houses.”

Risk Allowance

On risk allowance, we saw medics who are tending to coronavirus patients being given extra stipends for putting their lives on the line.

There is no much difference between medics and teachers especially now that they will be trained on how to deal with such positive cases within the classroom set-up.

It is high time the teachers’ unions woke up from their untimely slumber and demand for what rightfully belongs to their faithful adherents, teachers.

KUPPET and KNUT need to bargain for teachers given the risk that they will be exposed to if schools reopen in September.

Aged Teachers

Another elephant in the room is the presence of teachers within the high-risk ages. Most of these teachers are currently serving as senior teachers, senior masters, deputies, headteachers, or principals. They, therefore, play a key role in the management of learning institutions.

According to covid-19 statistics, most victims who succumb to the illness are aged 50 and above given that they are likely to be predisposed to other age-related health conditions such as diabetes that compromise their immune system.

A total of 1591 vacancies are for primary school teachers and 529 posts for secondary schools.

All eyes are now set on Dr. Nancy Macharia, the newly reappointed TSC CEO who earned herself another five years in office after a job well done.

In the teaching service, her reputation as an iron lady precedes her for she ruled with an iron fist for the past five years.

Given the peaceful reign enjoyed by the education sector, lack of industrial actions fueled by teachers’ unions over a pay rise, President Uhuru Kenyatta renewed her term for another five years despite opposition from the Law Society of Kenya and lobby group going by the name Midrift Human Rights Network.

DELOCALIZATION

One of her most controversial policies is the introduction of the delocalization policy which saw many teachers transferred from their home counties. Consequently, many school administrators were moved.

Last month, however, a circular signed by Dr. Macharia sought to decentralize the process of appointing school administrators- a possible graveyard for the highly contested policy.

In the Circular, the Commission took back the process of appointing senior teachers, masters, deputies, heads, and principals to the regional and county levels.

Another policy that she will be remembered for is the introduction of Career Progression Guidelines, CPGs, and regular appraisal of teachers. These are currently being used to promote teachers from one grade to another.

DIVIDE AND RULE

Besides, the CEO is accused of being the force behind the bad blood between KNUT and KUPPET, the two teachers’ giant unions.

In the past two years, KNUT and TSC have not been reading from the same script in as much as the implementation of Career Progression Guidelines, teachers’ promotions, implementation of CBA, CBC roll-out, and teachers’ delocalization are concerned.

The incessant wars culminated in countless court cases, deregistration of KNUT Boss Wilson Sossion, proposal to delink TSC from KNUT and failure to collect and remit KNUT union dues from members.

TSC and KNUT wars have cost the union an arm and a leg with KNUT members pulling out of the union and going for a rival union, KUPPET which seems to have gained favor from the Commission.

KUPPET is currently enjoying agency fees from more than 30, 000 teachers, the majority of whom were KNUT members.

KUPPET’s membership currently stands at 79,000 with 31, 000 more applicants expected to join the union.

More than 18, 000 school administrators-principals, heads, and deputies have also left KNUT for KUPPET to shield their payslips and get promoted.

This is after the TSC suspended promotions for all KNUT members now that the union did not subscribe to the newly introduced Career Progression Guidelines, CPGs that are currently being used to promote teachers.

NEW TERM

As she commences her new term, Dr. Nancy Macharia is expected to address the biting effects of Covid-19 on the education sector, especially the teaching service in Kenya.

She is also expected to negotiate with teachers’ unions on the new CBA that has already been tabled by KUPPET. The union seeks to have house allowance harmonized for all teachers irrespective of where they are posted.

This is good news especially for tutors who were recruited in 2019 and have since been waiting for the reporting dates.

The teachers are now expected to report to their new stations on January 6, 2020.

Appointment letters have already been dispatched to the county offices.

School principals are hence expected to pick the letters.

Teachers Employed by TSC have been categorized into various job groups depending on experience and qualifications.

Prior to the latest CBA whose Implementation lapses June this year, job groups used to run from G for starting primary teachers to R for Principals.

However with the signing of the CBA came the career progression guidelines(CPGs) that replaced the former scheme of service.

According to CPGs, the former grading system changed to B5 for starting primary school teachers, C1- C5 and D1-D5 for Principals.

 

Below are the details of the new job groups and the number of years before Promotions are attained.

1). Grade B5 (T- Scale 5); Established for Primary Teacher II

2). Grade C1 (T- Scale 6); For Secondary Teacher III, Lecturer III and Primary Teacher I,To C2 for diploma teachers is automatic after 3 years

If a teacher join service at the age of 30 after serving Bom and later as an intern teacher for 2 years it will take a minimum of at least 9*3=27 years for a teacher whose promotion is automatic after every three years without any form of stagnation.

This teacher will be chief principal when he will be 58 years ,the age one is supposed to work from home.

The Teachers Service Commission (TSC) has released new promotion interview dates for teachers. This follows an earlier cancellation of interviews that were slated for the 26th to the 30thof May 2022

 

One thing that has irritated teachers in the teaching profession is the way their promotions are handled. Most of them are highly qualified for promotion, but there is currently no compelling explanation why they have not been promoted.

 

 

 

The interviews could not take place on the earlier scheduled dates as most teachers were engaged in the marking of the Kenya Certificate of Secondary Education (KCSE) examinations. It took the intervention of the Kenya Union of Post Primary Education Teachers (KUPPET) to have the TSC postpone the interviews.

“In the circumstances, we urge the Commission to immediately call off the interviews slated for this month and conduct the same in July or on any convenient dates after the marking of the KCSE exams.” Read a demand letter from KUPPET Secretary General Akello Misori to the Commission.

 

It’s worth noting that a freshly hired graduate teacher will be placed in grade C2, which was previously known as job group K. The teacher will be promoted to grade C3 after three years. Despite possessing the qualifications for promotion, most instructors remain in grade C3, which used to be workgroup L.

 

In fact, the majority of teachers leave when their students reach grade C3. The majority of teachers believe that one day the commission will be fairer and encourage deserving teachers.

 

 

 

A teacher in grades C3 and C2 cannot hold an administration post, making these grades restrictive. A teacher must be interviewed in order to advance to grade C4. Qualified teachers are frequently asked to these interviews, which are usually advertised in the print media.

 

In July 2021, TSC embarked on the final phase of promotion of teachers for the financial year 2021/2022. A calendar of activities for the interviews was prepared with the last set of interviews scheduled to take place from 26/6/2022 to 30/6/2022.

 

How to pass TSC promotion interviews

 

Ensure that there is improvement in your teaching subject with respect to previous years. This means that there must be value addition in learners.

Prepare adequately for the interview day by doing proper research as far as the teaching profession is concerned.

Have a presentable filing system with all your professional documents including your teaching timetable

Ensure that you fill your TPAD form as a hard copy and soft copy within stipulated timelines

Proper documentation of any activity that you do. Even if you’ve counseled a student or participated in a community activity, there must be evidence. Nowadays the commission is evidence-based. This evidence can be produced during the interview day.

The state is attempting to remove representatives of doctors, churches, and teachers from the National Hospital Insurance Fund (NHIF) board.

This could stir a fresh conflict betweening the workers and employers.

The NHIF Act review via a government-backed Bill could lead to the removal of three directors that represent teachers unions, the Kenya Medical Association (KMA), and faith-based organizations.

According to the bill, the Attorney-General will join the board of the NHIF, giving the government a huge say in the cash-rich fund that collects over Sh. 58 billion from workers every year.

Employers and unions feel that the union belongs to workers who are responsible for funding its operations and not the government. They argue that the position enables them to have the right to influence the strategic direction of the fund via seats on the board.

“I am aware of the proposed changes but the rationale has not been explained. Having the Attorney-General as part of the board is anomalous, he is already an adviser to the government and so he should be removed from the board so as to continue playing the advisory role,” Jacqueline Mugo, the FKE executive director told Business Daily.

The FKE feels that the government, even though it is the single-largest employer, is mainly on the board as a trustee.

FKE normally represents the employers who remit over half of the NHIF contributions.

The Kenya National Union of Teachers and COTU handle the interests of the workers.

In three years, this is the second time that the government has tried to remove NHIF directors gotten from the teachers’ union, faith-based organizations as well as the doctors association.

A similar push of removing representatives via a review of the NHIF Act did not go through in 2018.

At the end of June, the NHIF board had 8.466 million members with 4.299 million from the formal sector while 4.167 million are from the informal sector.

The Review of the NHIF board comes as the State is considering what to do with the universal health coverage (UHC) scheme for outpatient and inpatient services, including maternity, cancer, dialysis, surgery, and treatment.

Every household will need to make a compulsory monthly contribution of Sh. 500 or Sh. 6000 every year to the NHIF as they seek to offer health cover for all Kenyans.

The Planned Mandatory NHIF membership will be an upgrade on the ongoing scheme where only workers who are in the formal sector have to join.

The state is offering to sponsor one million poor households at the beginning of the UHC scheme. The UHC is modeled on the United States’ Obamacare that requires all Americans to buy an insurance cover.

According to the World Bank, because of the low penetration of insurance, one-quarter of all healthcare bills of Kenyans are paid from their pockets.

This means many families are vulnerable and reliant on   donations from other disposals of assets like livestock.

Attainment of the UHC is expected to be by 2022. This will expand NHIF after many years of false starts.

The Teachers Service Commission, TSC has introduced charges for teachers who would like to have the Commission review their disciplinary cases after the first hearing.

According to the TSC’s latest circular, any teacher who is dissatisfied with the Commission’s decision regarding his or her disciplinary case will be forced to part with Kshs 2, 000 for the case to be heard again.

The teacher should then forward the bank deposit slip to the TSC headquarters (Discipline Division) for further processing of the review application.

THE TSC DISCIPLINARY ACTION

The Teachers Service Commission has the mandate to discipline teachers who go against the TSC Code of Conduct and Ethics which govern teachers’ behaviour.

Teachers who violate these regulations are likely to face disciplinary action from the Commission which may include and administrative warning, an interdiction or dismissal depending on the offence committed.

THE TSC DISCIPLINARY PROCESS

-The head of an institution issues a verbal or written warning once the teacher in question commits the offence.

-If the teacher continues to breach the TSC Code of Conduct despite receiving an administrative warning, s/he will be required to write “a show-cause letter” explaining why the Commission should not take disciplinary action against him or her.

-Depending on the explanation offered by the teacher, the head of the school may give the teacher a warning or forward the case to a TSC agent.

IF THE DISCIPLINARY CASE IS FORWARDED TO A TSC AGENT, S/HE SHALL:

1. Conduct a thorough investigation and collect evidence on the case in question.

2. Give the accused teacher a chance to defend himself or herself in writing against the allegation(s) levelled against him or her.

3. The next step involves the calling of witnesses to provide evidence in the presence of the teacher in question.

4. The accused teacher will then be given a chance to cross-examine every witness.

5. In case the accused teacher fails to turn up for this process, then the agent shall interdict him or her.

N/B: THERE ARE THREE POSSIBLE DECISIONS BY THE AGENT:

a. Warn the accused teacher (Issuing an administrative warning)

b. Interdict the accused teacher

c. Dismiss the case (No case to answer).

If a teacher commits a serious offence, then the TSC or the agent can interdict the teacher without inviting him or her to the preliminary hearing of the case.

IN CASE OF AN INTERDICTION

The interdicted teacher should:

– Clear and leave the school within 48 hours (2 days) after receiving the interdiction letter.

– Write a defence statement within three weeks (21 days) from the date of the interdiction and give a contact address.

The case will be heard within three months. If the Commission fails to do so then the accused teacher should make a follow- up.

CAN A TEACHER BE PAID HIS OR SALARY DURING INTERDICTION?

A teacher who commits the following offences shall receive half salary during the interdiction period:

Desertion of duty

Absenteeism (chronic)

Having been jailed or held in legal custody

Mismanagement of public funds

Forgery

Immorality (Carnal Knowledge with students, CK)

Impersonation

DURING INTERDICTION

The interdicted teacher is expected to report- once a month to the Teachers Service Commission’s nearest sub-county office. This helps in providing the most recent contact address of the teacher.

TSC DISCIPLINARY PANEL

The TSC shall then compose a disciplinary panel who shall determine the outcome of the case in question.

Within 28 days after the hearing of the case, the TSC shall inform the accused teacher of the decision arrived at and give a plausible explanation.

If the teacher is not guilty, the TSC shall revoke the interdiction.

If the teacher is guilty then s/he may be forced to retire due to public interest or be dismissed.

The teacher can also be deregistered by the TSC.
