Teachers have threatened to boycott their duties next week should the government, through the Teachers Service Commission (TSC), fail to address their grievances.

The Kenya Union of Post Primary Education (KUPPET) submitted a list of their demands to TSC. They want the commission to negotiate and implement the 2021-2025 Collective Bargaining Agreement (CBA), with the current one set to expire next month.

They also demand teachers be offered a 70 per cent pay rise in the next CBA, from the current 30 per cent. Further, they are calling for salary increase arrears for over 3500 technical and vocational education and training (TVET) teachers transferred from TSC to the Public Service Commission (PSC) as stipulated in the 2017-2021 CBA.

“Teachers expect nothing other than a salary review this year. We have gathered that TSC was advised by the Salaries Remuneration Commission (SRC), but TSC has not shared the advisory with us,” said KUPPET Secretary General Akello Misori.

Teachers under the Kenya National Union of Teachers (KNUT) are yet to issue their stand.

The Teachers Service Commission (TSC) has replied on the status of the imminent teachers Collective Bargaining Agreement (CBA) planned to be signed ahead of July 2021.

This follows the Kenya Union of Post Primary Education Teachers (Kuppet) Secretary-General Akello Misori’s letter to Nancy Macharia expressing concern about the delay in concluding discussions on the new CBA.

Misori noted that for the past two years since they initiated talks on the new CBA, TSC has consistently snubbed their efforts to have structured talks.
“As a union, we have diligently discharged our obligation under the Labour Relations Act, but the government has been dragging its feet for more than a year,” said Akello Misori, the Kuppet secretary-general.

According to KUPPET, all that remains in the negotiations is for the Salaries and Remuneration Commission (SRC) to give its advisory report to TSC to allow it to table a counteroffer to the union.

But in reply, the teachers’ employer said it has noted the union grievances and acknowledge they are valid. TSC further promised teachers that it is taking all steps to ensure the subject is addressed in the shortest time possible.

“The Commission has duly noted your sentiments on the above subject matter (CBA 2021 – 2025) with which we concur to be valid. I wish to assure that the Commission is taking all the steps to ensure that the matter is addressed in the shortest time possible,” said TSC CEO Dr Nancy Macharia.

In April National Treasury Cabinet Secretary Ukur Yatani wrote a letter to the Salaries and Remuneration Commission (SRC) stating that his ministry won’t release about Sh83 billion in salary increase that the State owes civil servants and teachers.

The letter dated March 18, addressed to Anne Gitau, the Commission Secretary at SRC, got a shocking reply from Yatani who attributed this to budgetary constraints to the forthcoming General Election and the adverse outcomes of the Covid-19 pandemic.

Both KUPPET and Kenya National Union of Teachers, KNUT protested the decision. Teachers and civil servants later threatened to down their tools if the government does not honour the numerous collective bargaining agreements (CBAs) it struck with them.

The implementation of the 2021 – 2025 CBA is supposed to commence on July 1, 2021. About 320,000 teachers countrywide are anxious as their current CBA is weeks to expiry. TSC has failed to make a counteroffer to the one made by the unions in the 2021-2025 CBA.

The expiring CBA signed four years ago was implemented in phases for Sh54 billion and will expire on 30th this month. CBAs are normally discussed and implemented across 4 years.

Generally, discussions for a new cycle between unions and TSC are made at least a year before the lapse of the existing one. Yatani stated that a total of Sh42 billion will be spent in the coming general elections.

“We have already factored Sh10 billion in the Financial Year 2021-22 ceilings for the preparatory activities,” said Yatani, adding that the outstanding balance will be factored in the subsequent financial year.

This combined with a bit in taxes collected, forced the Exchequer to set aside just Sh6.8 billion, or 10 per cent of the Ksh68 billion intended for the 4-year salary reviews for teachers and civil servants in the upcoming budget.

The remaining cash, Yattani said, would be released in phases in the 2022-2023 to 2024-2025 financial years. But, labour union leaders castigated the treasury for using elections and Covid-19 as an excuse to deny workers their dues.

“The Government and employers should prepare for stiff resistance from unions,” said Wilson Sossion, KNUT Secretary-General, adding that the economy is more than capable of providing Sh83 billion, with close to two-fifths of this allocated for teachers.

The Treasury has projected that it will accumulate Sh1.76 trillion from taxes in the financial year starting July even as it tries to turbo-charge an economy that has been ravaged by the pandemic.

“Further, due to the negative effects of Covid-19 on the economy, we expect the economy and the projected slow recovery, revenue performance over the next two years,” said Yatani.

The National Treasury stated that it expects the economy to recover this year, increasing at around 7 per cent compared to slower estimated growth of 0.6 per cent in the last year.

Cotu Secretary General Francis Atwoli noted that global economies have been ravaged by the pandemic but noted that counties make annual budgets hence workers do not have to wait for 4 years. He added that the funds being borrowed should be used to support Kenyans.

“I said it that the billions we are borrowing should supplement our budgetary allocations and also fight of Covid-19. But not to be pocketed by a few individuals,” said Atwoli. Public Finance Management Act 2012, however, does not permit the Government to spend borrowed money to for salary purposes.

KNUS SG stated that excessive borrowing in the economy can never be used to punish teachers and civil servants. “The CBAs must be funded as recommended by SRC. The Treasury and government cannot undermine what has been recommended by SRC,” said the ODM nominated MP.

Kenya Universities Staff Union (KUSU) said that the State must look for funds for the workers’ CBAs or risk industrial action.

“Kenyans pay taxes and workers are the Kenyans. So they will have to get what is due to them. The Government must look for money to implement CBAs,” said KUSU Secretary-General Charles Mukhwaya. “Sh6 billion is a drop in the ocean and a big joke.” He added.

Kenya Union of Post Primary Education Teachers (Kuppet) Secretary-General Akelo Misori however declined to comment on the topic. “No comment at the moment,” said Misori.

KUUPPET had held a 3-day retreat in Naivasha to discuss out pending issues in the CBA and to lay the ground for the next stage of the agreement. Union insiders however said the transit would be a huge setback for classroom teachers, who were hoping to mainly benefit from the next CBA. In the current Sh53 billion CBA, classroom teachers were awarded a raw deal.

Union of Kenya Civil Servants Deputy Secretary-General Jerry ole Kina announced that they are in the last phase of their CBA and remarked that they have been in negotiation with the Government and were expecting the government on Monday.

“Before we can comment, let’s hear them first. If it’s a positive answer we shall welcome it. If this is for the entire public service then we need to know the fine details of what they are talking about.”

Atwoli took issue with how public servants’ CBAs have been structured. CBAs, he maintained, should be of 2-year cycles and not 4 years as is the existing practice.

“And they have arm-twisted the unions to accept the four-year cycle, which is illegal, unconstitutionality against the ILO (International Labour Organisation) conventions,” said Atwoli. Atwoli noted that with 2 years cycle the subject of general elections would not occur.

Atwoli said for good industrial relations, the Government must call unions and employers such as the Teachers Service Commission (TSC) to a meeting for presentations and justifications for their planned actions.

“Meet all the union leaders and explain to them why they want to pay less and also allow unions to ask questions like why pay less and Kenyans are paying taxes,” said Atwoli.

The Teachers Service Commission, TSC recently rolled out Teacher Professional Development, TPD, refresher courses for all teachers.

According to the Commission, all teachers are expected to enroll for these refresher courses and horn their teaching skills and nourish their professional knowledge.

Teachers, who are the key stakeholders are however dissatisfied with the decision and feel pushed to the wall now that their employer is not planning to meet the cost of TPD training.

This is what prompted the Members of Parliament to hold a discussion on the newly introduced Teacher Professional Development TPD modules.

According to a petition brought to the house by Honourable Omboko Milemba, the members of parliament have demonstrated their support for teachers against the compulsive action by Teachers Service Commission to force teachers to go back to class. According to the circular from the commission, all teachers in public schools must undergo teacher professional development course every six months, a programme set to be offered in four chosen universities.

Luckily, members of parliament have argued that teachers are human beings like other government employees and should not be subjected to such stress. The move by the commission contravenes labour practice which protects employees from being forced to undertake refresher courses without proper structure. Further arguments include the manner in which the four universities were chosen terming it suspicious. Concerning the charges they have been called upon to pay for the course, legislatures stated that teachers have committed their salaries therefore the employer should fund the program.

This is How TPD will Work

TSC TPD Programme
The Teacher Professional Development (TPD) programme was officially launched by KNUT’s Collins Oyuu, KUPPET’s Akello Misori, KUSNET’s James Torome, and TSC CEO Nancy Macharia on 22 September 2021.

The main aim of TPD training is to provide professional development of teachers.

TPD raining targets TSC teachers in primary and secondary schools for both private and public schools.

Some of the higher institutions of learning that have been selected by TSC to offer TPD training like Mount Kenya University, Kenyatta University, Riara, Kenya Education Management Institute (KEMI), etc. have opened applications for the TPD training that is set to start in December 2021.

Only TSC registered teachers are eligible for TSC TPD training.

TPD training Cost

Teachers will be required to pay Ksh 6,000 per year. Therefore, after 30 years of TPD training, the teacher would have paid Kenya Shillings 180,000.

Mode of TPD learning

Teachers will be able to learn face to face and online. Face-to-face learning shall be done during the school holidays. Teachers can take TPD online courses during their free time in school.

MKU has indicated that a TPD Mobile App will soon be available for teachers to download and install on their phones. The TPD Mobile App will be used for payments, registration process, access to learning resources, and communication.

TPD Course outline (Modules and Chapters)

TPD course is divided into modules and chapters (units).

Introduction module: Has five chapters and takes one year to complete (1 Year)
Level 1 Module: Has 5 chapters and each chapter takes one year to complete. Therefore, it takes 5 years to complete level one module. The same applies to Level 2, 3, 4, 5, and 6.
Level 2 module: 5 years (5 chapters)
Level 3 module: 5 years (5 chapters)
Level 4 module: 5 years (5 chapters)
Level 5 module: 5 years (5 chapters)
Level 6 module: 5 years (5 chapters)
A teacher is only allowed to take a maximum of 7 years per level. It, therefore, takes a minimum of 31 years to complete the TPD course.

TPD Certificate and Transcript

Teachers will be issued with a transcript after completion of each chapter. TSC will also be sent a copy of the transcript.

A certificate will also be issued after completion of the TPD course. The certificate must be renewed after every five years.

How to Prepare for TSC  Promotion Interviews 2021: Which Documents Should I Carry and How should I arrange Them?

The Teachers Service Commission, TSC, has released the lists of shortlisted applicants for the 15,000 advertised promotions vacancies in 2021.

Teachers who applied for promotions vacancies can now download the lists and check their respective interview dates, venues and time.

The lists feature names of applicants for Deputy Principal I, Deputy Principal II, Senior Lecturer, Deputy Principal III, Curriculum Support Officers, Head Teacher, Senior Master IV, Deputy Head Teacher II, Senior Lecturer IV and Senior Master IV promotion vacancies.

The interviews will be carried out between February 8 and 19, 2021 at TSC County offices countrywide. The county interview committee shall be composed of: the county director (chairperson), host sub county director (secretary), the county Human Resource Officer and all other sub county directors from the county.

WHAT TO EXPECT DURING THE INTERVIEWS.

TSC Promotions 2021; Gone are the days when classroom teachers filled with disillusionment could neither dream nor look forward to TSC Promotions thanks to the implementation of the Collective Bargaining Agreement signed between TSC and teachers’ unions.

2021 specifically is a historical period especially for classroom teachers stuck in former Job  Group L, C3 who have thirsted for TSC promotions for years on end.

This is simply because their employer for the first time in history announced the highest number of promotion slots for these teachers which saw a total of 6, 680 Teachers promoted to Job Group M, C4 setting the pace for their future career progression to N and P (Deputies and Principals).

Although there are a number of factors that may have played a key role to see TSC declare the highest number of vacancies for senior teachers and masters in 2021, the fact that many school administrators have hit the prime age for retirement plus the susceptible nature of aged teachers who are currently entrusted with running public schools may have set the bait.

TSC Promotion Results for Senior Master IV T-Scale 9: Key Statistics

In the 2020/2021 TSC promotion cycle, a total of 350 teachers were lucky to be listed among those promoted to Senior Master IV.

According to TSC Promotion letters dispatched to the afore-mentioned category of teachers, they will now begin enjoying better salaries with effect from March 2021, their latest appointment date to the higher grade.

The latest Circular released by the current  TSC CEO Dr. Nancy Macharia, whose term was renewed by President Uhuru Kenyatta for the next five years in 2020, indicates that the Commission took into account particular factors in compiling the final list of promoted senior masters in 2021.

Some of the factors that influenced the 2021 TSC Promotions Results were reviewed to encompass regional balance, gender equity, and affirmative action for Arid and Semi-Arid Areas, ASAL.

The above factors were coupled with the latest TSC Promotions Guidelines for Teachers enshrined in the TSC Act 2012 and Career Progression Guidelines to ensure equitable distribution of TSC Promotions across the regions and counties.

TSC Response to Partiality and Nepotism Claims During the 2021 TSC Promotions

Prior to the official release of the 2021 TSC promotions Results by the Commission, there arose claims pointing fingers at TSC for relegating teachers in Kajiado County.

According to the leaders from Kajiado County who took it upon themselves to address the complaint, TSC has been promoting teachers from a foreign community only leaving behind “native sons and daughters”.

The dethroning of sons and daughters of the soil in Kajiado County when it comes to TSC Promotions is against the TSC Act and Career Progression Guidelines.

The Teachers Service Commission CEO Doctor Nancy Macharia however offered a speedy response to the claims that would have otherwise tarnished the reputation of the Commission that is believed to offer equal opportunities to Kenyan teachers seeking recruitments and greener pastures.

In her response, TSC Boss Dr. Nancy Macharia alluded to the TSC Career Progression Guidelines, CPGs, and the TSC Act 2012 saying

“All vacant positions are advertised and filled competitively. All teachers are given equal opportunities through interview sessions.”

She further adds that the above considerations were applied in addition to the minimum qualifications for teachers in promoting teachers to the next grade.

The Teachers Service Commission is declaring soon declaring 5, 000 vacancies to fill the huge learning gaps in both secondary and primary Schools. The 5000 posts will therefore be spread across several primary schools and secondary schools in Kenya.

The teachers likely to be recruited in July 2022 will count themselves lucky since they will serve on Permanent and Pensionable terms of service.

 

Eligibility/ Selection: TSC Renews Recruitment Requirements for Permanent and Pensionable Employment of Teachers 2022-2023

The Teachers Service Commission has at the same time revised recruitment requirements for teachers on permanent and pensionable terms.

Since 2019, any teacher wishing to bag advertised teaching slots in both primary and secondary schools must serve on contractual terms technically referred to as TSC Internship that are renewable annually first before proceeding to seek for permanent and pensionable recruitment.

To qualify for 2022-2023 TSC recruitment, a candidate should also meet the following basic requirements:

 

i) Be a Kenyan citizen;

ii) Must be a holder of a P1 certificate in the case of primary schools and a minimum

of a diploma in education in the case of secondary schools;

iii) Must be a registered teacher with Teachers Service Commission.

 

 

 

How to apply for TSC Recruitment 2022-2023

Interested and qualified candidates should submit their applications online through the Commission’s website, www.tsc.go.ke under ‘Careers’ or teachersonline.tsc.go.ke not later than the stated deadline.

i) The Teachers Service Commission Recruitment Guidelines 2021/2022 FY shall apply.

ii) Only shortlisted candidates will be contacted.

iv) Shortlisted candidates will be required to produce original professional and academic certificates;

TSC Lets intern teachers to apply for January 2022 replacement vacancies

The Teachers Service Commission (TSC) has given all current intern teachers a chance to apply for the advertised 892 posts for secondary schools and 2,053 posts for primary schools it announced yesterday despite the period they have served.

Early January the Commission posted a total of 1,995 intern teachers to schools.

The Commission had advertised 1,995 teacher internship posts in September 2021 where 1,038 posts went to primary schools and 957 posts to secondary schools.

TSC said the recruitment of the intern teachers was in support of the Governments initiative to develop a pool of young talents for the Kenyan Labour Market.

“TSC is determined to see that teachers are properly staffed. It is working with Ministry of Education to ensure enough teachers are provided by recruiting 5,000 teachers every year and also by engaging intern teachers,” reads a section of the policy.

TSC also extended internship for 4,005 teachers whose one year term ended in December 2021. TSC employs at least 6,000 intern teachers each year.

Interns attached to primary schools get a monthly stipend of Kshs. 15,000/= while those in secondary schools get Kshs. 20,000/=.

In the year 2020 recruitment of teachers on permanent terms TSC failed to automatically confirm intern teachers, instead it awarded them ten marks for serving under internship.

However in the new score sheet it released to guide recruitment of teachers in July 2021, TSC directed 30 marks to be awarded to applicants who will provide “evidence of internship service”.

There are still complains by some teachers on why intern teachers should be awarded 30 marks when some have served for less than two months under internship.

Some years ago TSC used to bar intern teachers from applying for permanent and pensionable jobs once under internship.

The teachers were only allowed to apply after finishing their contract. However this has changed.

Yesterday the Commission declared 2,945 vacancies to replace teachers exiting service through natural attrition i.e. 2,053 posts for primary schools and 892 posts for secondary schools.

THE EFFECTIVE DATE FOR POSTING 2ND QUARTER OF PENDING CASES

The Teachers Service Commission is a constitutional Commission established under articles 257 of the Constitution of Kenya and is mandated to manage teachers and secretariats on employment and hiring process.

I therefore (DIRECT) that the contract teachers of the second quarter to be posted this month from 28th April 2025 to allow the smooth running of the IPPD payroll to avoid mixing up contract and permanent terms on payroll, as we use one payroll with different terms of appointment.

Teachers who are to be posted under permanent terms and replacement for those who retired from service should start getting their posting letters as from 29th May 2025 after we rolled out the payroll for April 2025 by this time posting letters should be released within one week before the National Budget reading.

Please note that all second quarter posting of teachers should end by 18th June 2025.

How to fill the Wealth declaration form online; the ultimate guide
Section 26 and 27 of the Public Officer Ethics Act (POEA) requires all public officers to declare their Income, Assets and Liabilities (IAL). Since 2003 when the law requiring Public Officers to declare their Income, Assets and Liabilities (IAL) was enacted, the mode of declaration has been manual. Nowadays, the declaration is done online via portals provided to Public and Civil Servants in Kenya. All teachers are thus expected to fill an online Declaration by December 2021.

MODE OF DECLARATION
The Commission in 2017 Introduced an online Declaration Portal. This is the portal to be used for the 2017-2019 declarations. Declarations can be made following the steps outlined in the DIALS Manual.

The Declaration of Income, Assets and Liabilities form contains the following fields:

TSC allowances news 2021– The Salaries and Remuneration Commission, SRC, has hatched a major shake-up that will see several civil employees including teachers deprived of a good number of allowances.

List of Allowances

The radical surgery will see some of the allowances being abolished and others restructured.

A 2019 study by SRC identified 247 allowances paid to public officers, which accounted for 48 percent of the total wage bill as of 2019. This was against 31 allowances in 1999. The Public Finance Management (PFM) Act 2015 stipulates that the national government’s expenditure on the wage bill should not exceed 35 percent of ordinary revenue.

In the current salaries review, exercise SRC aims at minimizing disparities in gross remuneration package with the ultimate aim being to cap allowances at 40 percent of basic pay.

While addressing journalists, recently, Chairperson Lyn Mengich said the new cycle may take effect six months after June, a time when the commission projects to have completed the review.

“Everybody will be affected. Some will impact more on other sectors of the employees. New employees will be affected where an allowance is being abolished. If provided for in a contractual obligation, it will not affect immediate staff enjoying that benefit,” She said.

Why SRC is reviewing the allowances

To avoid duplication, redundancy, disparities, and varied eligibility criteria, allowances payable in the Public Service shall be harmonized and streamlined as follows:

Allowances and benefits that are paid for similar purposes but have different names shall be merged and renamed;

Allowances and benefits whose rates are not commensurate with the intended purpose shall be restructured;

Allowances and benefits whose current form does not change shall be retained; and

Allowances and benefits whose rationale for payment is redundant and or overlaps with that of the basic salary shall be abolished.

The Commission says allowances and benefits shall not be paid for purposes that are already compensated for in the basic salary thus resulting in a remuneration package that exceeds the relative worth of a job.

Streamlining of Allowances and Benefits

To avoid duplication, redundancy, disparities, and varied eligibility criteria, allowances payable in the Public Service shall be streamlined by:

Merging and renaming allowances and benefits that are paid for similar purposes but have different names;
Restructuring allowances and benefits whose rates are not commensurate with the intended purpose;
Retaining allowances and benefits whose current form does not change; and
Abolishing allowances and benefits whose rationale for payment is redundant and or overlaps with that of the basic salary.
Reviewed TSC allowances

TSC allowances that will be restructured include:

Annual Leave Allowance
It is an allowance that is paid once a year to teachers while on leave; usually paid with the January salaries. The Commission is intending to review this allowance due to the following reasons:

The wide banding of job group eligible for Annual Leave Allowance is discriminative;
There is a disparity in the rates payable in the Public Service.
Some public sector institutions pay Annual Leave Allowance as a percentage of the basic salary, other institutions pay Annual Leave Allowance as an absolute figure.
Some public institutions allow for the commutation of non-utilized leave days for cash.

Consequently, this is how the annual leave should be paid;

The Annual Leave Allowance shall be paid in absolute figure and not a percentage of basic salary. Indeed, this how TSC pays the annual leave for teachers, and hence no many changes are expected here.

The SRC shall review the banding structure in the Annual Leave Allowance payments to provide clarity in banding and rates payable by the teacher’s grade.

Hardship Allowance
This is an allowance that is paid to teachers deployed in designated hardship areas. The allowance is meant to compensate teachers working in the Hardship Areas to compensate them for lack of basic social services and amenities, security risk, harsh climatic conditions, isolation, and family separation.

Some teachers are set to lose the hardship allowance because the designated hardship areas shall be reviewed, by the relevant government institution/s to reflect changes in designated hardship areas arising from benefits of devolution and Equalization Fund. This is because devolution has implied that Counties are no longer necessarily hardship areas since they are receiving equalization funds to promote development in the counties thereby addressing the characteristics of hardship areas.

Responsibility Allowance
This is an allowance paid to teachers in administrative posts. SRC has since abolished this allowance because the purpose for which the allowance is paid has been factored in the relative worth of the job through the job undertaken by the Commission. Indeed, this allowance was incorporated in the basic salaries for teachers holding administrative roles.

Medical Allowance
The allowances are paid alongside monthly salary based on the job group to cater for outpatient medical treatment. The allowance has now been abolished. Teachers lost their medical allowance some time back; and, part of it is paid to the National Hospital Insurance Fund (NHIF; which is a statutory deduction) and the remaining goes to the TSC procured medical insurance scheme, AON-Minet.
