TSC Pressed hard on the status of teachers’ medical scheme and the government’s policy on hardship, housing, and other allowances for teachers.

The National Assembly Committee on Education, chaired by Hon. Julius K. Melly has questioned the Teachers Service Commission on the status of teachers’ medical scheme and the government’s policy on hardship, housing, and other allowances for teachers.

Appearing before the Committee, TSC Acting Chief Executive Officer, Ms. Evaleen Mitei outlined the scope and performance of the existing three-year medical scheme running from December 1, 2022, to November 30, 2025.

She explained that the scheme covers all teachers and their dependents under a family size of M+6 where both spouses are teachers and M+5 where only one spouse is a teacher.

“The current medical cover provides a wide range of benefits including inpatient, outpatient, dental, optical, maternity, local and international evacuation, as well as funeral expenses. In addition, we have enhanced the cover to address emerging challenges such as premature births and delays in pre-authorization,” Ms. Mitei said.

Hon. Julius Melly pressed for assurance that the services meet teachers’ needs.

“Have you done an assessment of the current medical cover and how it is working for teachers.”

The Commission also revealed that consultations are underway to transition teachers, alongside civil servants and the National Police Service, into the newly established Public Officers’ Medical Scheme Fund under the Social Health Authority (SHA).

Ms. Mitei informed the Committee that a Technical Working Group comprising the National Treasury, Office of the Attorney General, TSC, the Police Service, and SHA has been constituted to address the legal and financial framework.

She added, “It is proposed that teachers will be on-boarded to the new scheme under SHA from December 1, 2025, once all consultations and frameworks are finalized.”

Lawmakers questioned the involvement of teachers in the decision to move to SHA.

Hon. Phyllis Bartoo and Hon. Rebecca Tonkei asked whether the teachers through their inoka have been engaged in public participation and stakeholder engagement.

Committee members expressed concern about the transition. Committee Vice Chair Hon. Eve Obara noted, “We have has this medical cover for years and the current medical cover is expiring in a month. Are you going to be able to onboard all these teachers into SHA in this short time.”

She added that, “We cannot afford a downgrade of benefits. Teachers have long complained of delays and denials; SHA must guarantee better, services.”

Hon. Clive Gesiaro emphasized the need for accountability, “We want to see timelines, we want to see deliverables. Teachers cannot be left in limbo during the transition.”

On the matter of allowances, the TSC informed the Committee that the designation of hardship areas is the mandate of the Ministry of Public Service, Human Capital Development and Special Programmes, through Legal Notice No. 534 of 1997.

Ms. Mitei explained that hardship allowance continues to be paid to teachers in designated regions, while house allowance is paid under categories of Nairobi, major municipalities, and other areas as guided by the Salaries and Remuneration Commission (SRC).

Hon. Abdul Haro noted with concern that the TSC was referring to a gazette notice from 1997. “This is an outdated gazette notice. Hardship areas in the country have changed since 1997.”

She clarified that following SRC’s advisory and the 2023 addendum to the 2021–2025 Collective Bargaining Agreement (CBA), Isiolo Municipality was upgraded from Cluster 4 to Cluster 3 for house allowance effective July 2024.

“Teachers in Isiolo are now benefitting from enhanced rates under Cluster 3, in line with other municipalities,” she said.

The Commission further indicated that the Ministry of Public Service is reviewing hardship designations to align with current socio-economic realities.

Committee Chair, Hon. Melly pledged to further engaged stakeholders on the medical scheme transition and the review of allowances.

“Our teachers deserve dignity and fairness. This Committee will continue to work with the Commission and relevant agencies on this matter,” he said.

Now that the KCPE/ KCSE exams are over, the affected teachers will smoothly transfer from their current work stations to the new ones indicated on the transfer letters without any form of disturbance.

As indicated earlier, all TSC teachers affected by the April 2022 transfers should collect their letters by Mid-April from their respective schools or sub-county offices so that they can plan themselves to report to the new work stations by April 27, 2022.

The Teachers Service Commission (TSC) will effect transfer requests for thousands of teachers in April 2022 after conclusion of national examinations.

The transfer letters for both classroom teachers and school administrators will be available at the TSC sub county offices country wide.

However school Headteachers and Principals will be incharge of collecting and issuing transfer letters to their respective teachers in schools.

Before that happens we want to let you know how TSC transfers are applied, sorted and approved, the terms related to TSC online transfers and the reasons that can make you get an inter county transfer.

TSC moved application for transfers to an online platform. Since then all applications for transfers must be done online.

Through a circular by the Commission’s chief executive, Dr. Nancy Macharia, said this is part of its 2019 – 2023 strategic plan aimed to automate and ease service delivery.

To apply for a transfer click Teacher Online Transfer Application Portal where you will be required to enter your TSC number, ID number and Mobile phone number then click ‘Login’.

A validation code will be sent to your registered mobile number. Enter the code sent your mobile phone and click ‘Login’.

Kindly note if you are not getting the code in your phone number know that is not the registered phone number. If this happens you are advised to consult your County TSC ICT officer for mobile number correction.

Once you click ‘Login’ the system detects whether the teacher is in a primary or post primary institution.

Click ‘Submit a Request for Transfer’ to proceed. After entering all the details and checking the declaration box and clicking ‘OK’ the system will display the teachers current station and the requested one.

If a teacher is requesting a transfer due to insecurity and/or medical grounds, the are required to attach supporting documents by clicking ‘File Attachment(s)’ button for the attachment.

The teacher can also edit, withdraw or print the transfer request.

Once the application has been submitted by filling the requisite areas, the application then proceeds to the Head of Institution by sending a notification to their official TSC emails.

The Head of Institution can also access the portal through the link sent in the email or directly through the link Teacher Online Transfer Application Portal.Once they access the portal, Heads of Institutions are required to indicate and submit their remarks.

If the transfer is within the county, it then escalates to the Sub County Director and County Director respectively.

However if it is a request to be transferred outside the County, it proceeds to the County Director and then to the Staffing Directorate at the TSC Headquarters.

Applicants receive the following feedback through display of transfer status.

Pending: This is displayed once the teacher’s application is successfully delivered awaiting remarks from respective supervisors.

Acknowledged: This is displayed if the teacher is eligible for transfer and awaiting the availability of vacancy and or the teacher’s suitable replacement.

Not Approved: This is same as when the teacher’s request is regretted. This is applicable if the teacher has not met conditions set as per the transfer policy for example having not served in the current station for a period of not less than five years since first appointment, lack of suitable replacement or vacancy.

Approved: This is displayed after the transfer committee approves the teachers transfer request. The teachers transfer letter is then issued through the Principal in the case of post primary institutions and through the County Director in the case of primary school.

NOTE: The policy on transfer of teachers is always subject to availability of a replacement as per the Curriculum Based Establishment for secondary schools and staffing norms for primary schools.

A teacher in primary school can be transferred within the county while teachers in secondary schools can be moved to any county.

TSC Mass Recruitment News Today: All eyes are currently trained on the teachers’ sole employer, TSC to gauge how fair the upcoming July mass recruitment interviews  will be.

Previously, complaints have been fronted through formal channels bordering on the unfair nature in which TSC recruitment vacancies are filled with some interviewees decrying tribalism and nepotism.

In June, the Commission advertised 9,000 vacancies for both primary and secondary schools.

This is after the commission was allocated 2.5b for employment of teachers in the 2021/2022  budget.

Qualified and interested teachers were called upon to tender their applications online through the TSC Portal www.tsc.go.ke.

Qualified candidates were only allowed to make an application on only three vacancies per candidate, amounting to only three schools.

Teachers have shunned this act by saying that the number of slots accorded to teachers were very few.

After successful applications, shortlisting will be done by the TSC and a merit list will be generated and will be sent to subcounty directors of education who inturn will send individual list to principals in schools that had a vacancy for employment.

Worst of it all, some counties delay to send the merit lists to principals and if they do, the principals also in turn delay to send the text messages to shortlisted candidates. Some candidates have been claiming of receiving interview invitation messages late and to be precise, a day to the interview date which is against the TSC guidelines which states that, shortlisted candidates will be notified seven days earlier before the day of interview.

As we all know, in any interview there must be a tie of candidates scooping the same marks in the process of interviews. Initially, it has been that incase of a tie, the panelists tend to look at the KCSE mean grade to break the tie, and if the mean grade is still the same, they were looking at the Grades in the teaching subjects and if hey are the same too, they were narrowing down to the KCPE marks in order to break that tie. But if all these fails, they were checking on the teaching practice grade that will now break the tie.

All candidates having this knowledge, it is a different approach as the Teacher’s service Commission has introduce a new approach of breaking the tie. They have now overlooked the form four grade as the first parameter that breaks the tie and they are now using the Teaching Practice grade. This has left many teachers questioning the credibility of the process and terming it as barbaric and lack of transparency in these interviews.

The teachers have sworn not to leave any stone unturned as they are set to make noise to the TSC boss Nancy Macharia so that this parameter they are using to break the tie can be removed once and for all as it is inconveniencing some candidates as some Universities tend to award the Teaching practice grades the ways the know you.

Therefore teachers, as you attend the interviews, just bear in mind that in case of a tie, your Teaching practice grade will be used to break that tie. Kindly  assess the possibility of winning that interview by comparing your Teaching practice grade if you feel you are likely to bag the slot in that interview.

Teachers whose registration certificate is lost, misplaced or destroyed will now have a chance to apply for a duplicate Certificate of Registration from the Teachers Service Commission (TSC) online without necessarily going in person to the Commission’s headquarters to apply for it.

In a memo to all TSC regional and county directors, the Commission moved the services to its online system effective February 7, 2022. It was signed by Dr. Reuben Nthamburi on behalf of the Commission’s Chief Executive Officer (CEO) and dated February 2, 2022.

Teachers will now be required to pay a non-refundable fee of Sh.2,060.

“The Code of Regulation for Teachers (2015), Regulation 32 (1) and (2) state that the Commission may on application issue a Duplicate Certificate of Registration to a person whose Certificate of Registration is lost, destroyed or misplaced upon payment of non-refundable fee of Ksh 2,060,” reads the memo in part.

According to the Commission, the move is aimed at reducing the number of teachers who frequently visit the Commission headquarters for the service, creating unnecessary human traffic. It also cuts down on costs for teachers in terms of money and time.

“The teachers requiring Duplicate/Replacement of certificates have been visiting the Commission for this service in person hence creating unnecessary human traffic,” adds the memo.

The Commission has further advised teachers to return the certificate to the Commission where there needs to be a change affecting particulars entered in the Commission’s register such as an error in ID number, names and postal addresses. However, there must be explanations or declarations to justify the proposed changes.

Where the full name is changed on account of marriage, the Commission has advised the affected teachers to provide proof of marriage, and in this case, a marriage certificate.

Last year, the commission moved all teachers’ leave of absence online effective December 1, 2021 in a move that is aimed at improving service delivery to its employees and stakeholders.

Recruitment, promotions and transfer of teachers have also been moved online in an apparent step towards the Commission providing most of its services online to improve service delivery in line with its 2019-2023 strategic plan.

According to the Code of Regulations for Teachers, a person is eligible to be registered as a teacher if the person is of good moral character, holds relevant academic and professional qualification from a training institution recognized in Kenya, and meets the requirements for registration set by the Commission from time to time.

Most recently, the Commission came up with a new policy highlighting requirements for those wishing to enter the teaching service where it proposed to remodel the Bachelor of Education programme and replace it with Bachelor of Arts (BA) or Science (BSC) plus a Post Graduate Diploma in Education (PGDE) from September 2021.

This meant that in the near future, the Commission will only register and employ teachers after successful completion of a professional postgraduate diploma.

According to the proposed policy framework, the entry grade into BA or BSC is pegged at Kenya Certificate of Secondary Education (KCSE) mean grade of C+ with a B-(Minus) in three teaching subjects.

This is a shift from the current arrangement where universities admit students into the Bachelor of Education programme with a minimum KCSE mean grade of C+ (plus) or its equivalent with C+ (plus) in two subjects of specialization. Tutors at this level teach three subjects at junior and senior secondary ranks.

The minimum qualification for entry into teaching service in Kenya at all levels is a Diploma in Education; that is, Diploma in Primary Teacher Education and Early Childhood Development Education – with those with P1 certificates being encouraged to upgrade to Diploma.

The latest revised entry qualifications for Diploma in Early Childhood Teacher Education is KCSE mean grade of C (plain) with C (plain) in all the subjects. Teachers at this level qualify to instruct in all subjects at PP1 and PP2.

For Diploma in Primary Teacher Education (DPTE), the requirement is a minimum KCSE mean grade of C (plain) or its equivalent and C (plain) in all the cluster subjects. Tutors at this level teach all subjects from Grades 1-6, with some specializations in indigenous and foreign languages.

Furthermore, for Diploma in Secondary Teacher Education, the entry qualifications for registration is a minimum mean grade of C+ (plus) in KCSE with C+ in three teaching subjects. Teachers at this point will teach three subjects at Junior (Grades 7-9) or Senior (Grades 10-12) secondary ranks.

What’s more, Diploma in Education SNE (Foundations, Primary and Lower Secondary Specialized Areas) will require a minimum mean grade of C (plain) or its equivalent at KCSE, with C- (minus) in all subject clusters. Consequently teachers at this level are to teach all subjects at foundation, intermediate, Pre-vocational and vocational levels at Primary and Lower Secondary ranks.

For Diploma in Technical Teacher Education Secondary, the new registration requirements are a minimum mean grade of C+ or its equivalent at KCSE, with C+ in three teaching subjects. Teachers at this level instruct in three subjects at Junior or Senior secondary. However, candidates with relevant diplomas and certificates in relevant technical subjects are considered for admission.

The Teachers Service Commission (TSC) has failed to factor in an allocation for teachers’ pay rise according to a report it released to the Committee on Education and Research of the National Assembly.

Teachers especially classroom teachers were expected to gain more on the new CBA starting July this year but this did not happen as the new CBA that was signed did not have any monetary implementations.

However, teachers may be in for a rude shock as the report, which was presented to the Committee on Education and Research of the National Assembly by the Parliamentary Budget Office.

TSC Mass Recruitment 2022/2023: TSC to Hire 13,000 high school teachers and 9,000 interns in July 2022,

The report shows that TSC has planned to use its increased allocation of 15 billion shillings exclusively to employ 13,000 secondary school teachers and 9,000 interns to cope with exits and the expected increase in enrolment when the junior secondary is rolled out in January 2023.

This is bad news for teachers who have been hoping that their employer might offer them a new Collective Bargaining Agreement (CBA). The issue of renegotiating the CBA was not discussed when TSC boss Nancy Macharia appeared before the parliamentary committee in early February to discuss their budget proposals.

Nancy Macharia told MPs allocations for other critical areas like promotion of teachers on competitive selection, the roll-out of a national biometric enrolment, and validation of teachers and gratuity to 3,358 contract tutors in northern Kenya had not been factored in

This move has prompted the Kenya Union of Post-Primary Education Teachers (KUPPET) to issue a strike threat. The union officials argue that the economy has now improved and call for the non-monetary CBA to be reviewed.

Last month, KUPPET, came up with a raft of demands to see increased perks for its members. In the proposal, KUPPET wants salaries and allowances for its members to be reviewed upwards by the TSC to cushion them against the increased Cost of living.

“The cost of living has increased rapidly over the last two years affecting the purchasing power of household goods and services. The transport cost has increased beyond the commuter allowance negotiated due to increase of fuel and general overall transport cost”, reads the document.

The union demands that the following issues may be considered for negotiations to cushion teachers in their delivery of services.

The Union demands that commuter allowance be increased by 50% of the current rate. The commuter allowance shall be paid as per Appendix. In the proposal, KUPPET also demands that leave allowance be paid based on one’s basic pay i.e., an equivalent of one month’s basic pay for all cadres.

KUPPET wants an increased leave allowance between 27,325 shillings. 43,694 shillings for the lowest-paid teachers in job group C2. Those in the highest job group, D5, are to get a leave allowance of 152,000 shillings. The leave allowance is payable once a year.

Have you recently received an overpayment of salary from the Teachers Service Commission, TSC? Well. Kindly note that the Teachers Service Commission receives money for teachers’ salaries from the exchequer. This therefore means that the Commission must be answerable to the way it spends the money allocated to it for recruitment, promotion of teachers, and other recurrent expenditure. Consequently, all teachers who received an overpayment will have their salaries deducted now that the Commission is on the spotlight for allegedly overpaying some staff.
 

TSC was flagged for overpaying some staff amid teachers’ shortage

 

The Teachers Service Commission (TSC) has been put on the spot for overpaying a section of its staff as the agency is reeling from a shortage of teachers.

 

 

 

According to the latest public audit covering the period to June 2021, the irregular payments may have drained some Ksh.3 billion and given irrecoverable salary advances to teachers.

 

The audit further reveals that the commission failed to remit over Ksh.2 billion in taxes deducted from staff.

 

Auditor General Nancy Gathungu wrote in the audit that some of the lost funds had been historical with the possibility that ghost teachers were paid between the years 1988 and 2000 when the teachers were still paid in cash and not through the banks.

 

TSC is said to have advanced some Ksh.10.5 million in salary advances, some of which were not documented while the rest were not being recovered at all.

 

“Further, an amount of Ksh.4,264,665 in respect to one hundred and forty-five (145) staff had no movement over the last twelve months. Management did not give any reason for non-recovery of the salary advances” Ms. Gathungu wrote.

 

Ironically, some of the TSC staff whose salary advances were not being repaid continued to draw more salary advances, raising the question of possible collusion to misuse funds allocated to the commission.

 

TSC could also not explain how it overpaid staff to the tune of Ksh.352 million some of which it had failed to recover in years.

 

 

Some teachers were overpaid to the tune of Ksh.33 million under unclear circumstances, funds the Auditor General says may never be recovered.

 

“Review of the detailed analysis of the payroll provided for the financial year 2020/2021 revealed that thirty-two teachers had an outstanding ‘salary overpayment’ balance amounting to Sh33,780,614,” Gathungu wrote.

 

“However, the repayment period for recovery of the outstanding amounts is beyond the retirement age of the respective teachers. The recoverability of the balance is therefore doubtful.”

 

One teacher had been overpaid by Ksh.4.8 million, an amount that was being recovered at Ksh9,056. This would need 44 years to recover, and almost impossible period to be in service, assuming the teacher had completed probation before such an advance was issued.

 

While most government institutions usually ask for KRA tax compliance to offer employment, more than 5000 TSC staff are not compliant because their taxes amounting to Ksh.2.2 billion were never remitted to KRA.

 

TSC was allocated some Ksh.2.5 billion to try and narrow its teaching staff gap which has widened beyond 100,000 and is likely to grow as the government continues rolling out the Competency-Based Curriculum, CBC.

It is confirmed that a list of shortlisted applicants has been sent to each county. This is from a memo dated 7th of November 2019 from madam Catherine Lenairoshi of TSC Corporate Communications office. The communique further notified all the shortlisted candidates to carry the following as they attend the interviews on a date that would be communicated in due course:

On the 8thof October 2019, the Teachers Service Commission(TSS) advertised for a whooping 10,300 teacher intern positions. These numbers were to take care of both the primary and secondary schools teacher biting shortage. The bigger number(6000) was for secondary schools perhaps in a bid to plug the severe staff shortage following the 100% transition clarion call. The 4,300 posts were reserved for the primary schools. All the applications were to be done online a great departure from the norm where teachers applied for the advertised positions at the school and sub-county education offices.

Salaries and deductions

According to the sources from TSC, it is confirmed that primary school teacher interns will pocket 10,000 while their secondary school counterparts will smile all the way to the bank to cash 15,000. It is important to note that these incomes are subject to statutory deductions. This is stuff like NSSF, NHIF among others.

The Grand promise

Tsc has confirmed that the successful interns will be offered permanent jobs. However, this will depend on the usual conditions: availability of funds and the interns’ performance.

Staggering numbers of pupils and students

It is important to note that the ever-swelling numbers of learners in public schools have thrown school managers to panic mode. This is because the resources allocated to schools are not commensurate with the recruitment of teachers and the provision of other essentials in these schools. Survey on the ground indicate that the shortage of teachers in secondary schools stand at a whopping 85,258 this year up from 57,380 last year. In primary the shortage stands at 30,357. This is so bearing in mind that the ministry has to plan for the 10million pupils and about 2.8 million students. This severe shortage has forced the school managers to hire teachers on BOM terms to alleviate the situation. This has created another challenge on matters funds because the government subsidies are not for personal emoluments forcing them to survive on shoestring budgets in a bid to implement learning programmes in schools. The swelling numbers also have strained teachers especially those on duty leading to low morale and possible burnouts.

Subjects with biting shortage.

According to TSC some of the worst-hit subjects in teacher distribution are physics, cre, history, agriculture, English and math. These subjects have fewer teacher trainees even at the teacher training institutions and universities. Ironically, schools are experiencing these acute shortages yet the country

HERE ARE THE MINIMUM TSC QUALIFICATIONS FOR CHIEF PRINCIPAL T-SCALE 15 

Chief Principal grade D5 is a promotional grade for administrators in secondary schools and teacher training colleges.

The Chief  Principal is the lead educator and accounting officer and is responsible for the  operational management of the institution. He/she is also responsible for the  development and implementation of education plans, policies, programmes and  curriculum activities of the institution.

Promotion to this grade will be competitive and subject to availability of vacancies  in the establishment.

 

REQUIREMENTS FOR APPOINTMENT AS CHIEF PRINCIPAL T-SCALE 15 GRADE D5

To qualify for appointment to this grade, a teacher must:-

  1. have served as Senior Principal T-Scale 14 for a minimum period of three (3)  years;
  2. be a holder of Master’s Degree in a relevant area;
  3. have satisfactory rating in the performance appraisal and performance  contracting process;
  4. have demonstrated ability to supervise, mentor and provide professional  support to other teachers;
  5. have successfully undertaken the relevant TPD modules;
  6. have a valid Teaching Certificate;
  7. meet the requirements of Chapter six (6) of the Constitution; and  viii. meet any other requirements deemed necessary by the Commission.

DUTIES AND RESPONSIBILITIES CHIEF PRINCIPAL T-SCALE 15 

The duties of a teacher at this level shall be to:-

  1. prepare lesson plans, lesson notes, timetables, schemes of work and maintain  academic standards in the school to ensure that the syllabus is covered in time  for evaluation;
  2. teach the subjects of specialization to impart knowledge, skills and attitudes  to learners;
  3. evaluate learners on subjects of specialisation and prepare them for national  and other examinations;
  4. coordinate and provide guidance and counselling services to the teachers, non teaching staff and learners and instil norms and values for harmonious co existence;
  5. ensure proper discipline is maintained in the school by the teachers, non teaching staff and learners to create a conducive learning environment;
  6.  supervise the interpretation and implementation of the curriculum and ensure teachers prepare schemes of work, lesson plans and other professional  documents;
  7. ensure that the necessary instructional materials are sourced, availed and  utilised by teachers and learners to support the curriculum implementation;
  8.  oversee the requisition of stores and the proper maintenance of inventories to  achieve accountability and optimal utilisation;
  9. promote harmonious relations and linkages between the school and  stakeholders for instance the local community, parents and private sector  organisations;
  10. introduce new ideas and programmes to ensure improvement in teaching and  learning in the subjects of specialisation;
  11. embrace teamwork through collaborative planning and teaching to ensure  consistency and improvement in curriculum delivery;
  12. serve as a role model and maintain learner discipline;
  13. interpret the curriculum in the school to ensure effective teaching and  learning;
  14. oversee the organization of workshops/seminars/symposiums to share ideas  to enhance performance;
  15. oversee implementation of remedial actions to support learners with  performance gaps;
  16. ensure health, safety and security of learners;
  17. oversee prudent management of institutional resources;
  18. ensure that learners are adequately prepared, registered and presented for the  national and other examinations;
  19. coordinate identification of an appropriate curriculum for the school to  provide more opportunities for learners in the optional subjects offered in the  curriculum;
  20. interpret and implement policy decisions on training, recruitment and  deployment of non-teaching staff in compliance with relevant laws and  regulations;

Teachers employed by the Teachers Service Commission, TSC have been left mute and dumb after the Salaries and Remuneration Commission, SRC  under the leadership of Lyn Mengich decided to ruthlessly freeze any salary rise anincrease in allowances for all civil servants for the next two years.

For many years now, teachers have been suffering blows after blows not only from their employer but also from the government on matters salary rise.

This is the end of an era ushered in by teachers’ unions which had a voice  before and could haggle and bargain on behalf of the teachers for better salaries.

Now that the Teachers Service Commission has succeeded in crippling the unions, especially KNUT by unfairly locking its members out of the current Collective Bargaining Agreement and salary rise, teachers will either bite the bullet or call for industrial action to salvage their payslips.

TSC Proposal on the July 2021 Pay Rise for Teachers

In preparation for the implementation of a new Collective Bargaining Agreement, CBA this year, the Teachers Service Commission proposed a pay rise of 16-32 per cent with classroom teachers who are currently underpaid for their essential services set for higher salary perks at 32 per cent.

School administrators on the other hand who constitute the minority of the teaching work force were warming up to a pay rise of 16 per cent having received their rightful dues in the previous CBA 2017-2021.

Although the teachers’ unions were opposed to the 16-32 per cent salary increment since it was too little given that the Commission was planning to effect it over a long period, four years, it was better than nothing especially for the classroom teachers who were sidelined in the former CBA.

Currently, there exists huge salary disparities between school administrators and classroom teachers engineered by greedy union leaders who were out to look out for themselves during previous  negotiations.

This is simply because the Commission had proposed that teachers go for increased allowances in 2017 such as commuter, house and leave allowances.

This would have greatly benefitted the teachers since allowances are not taxable.

Unfortunately, the unions would have been fried since their cut us pegged on the teachers’ basic salaries, not allowances.

This is what necessitated them to accept a bogus CBA that did not benefit the classroom teachers much.

SRC Response on TSC Teachers Salary Rise 2021

The Salaries and Remuneration Commission, SRC recently conducted another job evaluation exercise for teachers which proved the great injustice that was meted on classroom teachers’ pay slips four years ago.

SRC’s findings arrived at the conclusion that classroom teachers were given a raw deal or rather the tail while school administrators had the rest of the cow to devour.

According to SRC, classroom teachers play over 30 roles including classroom management and helping the school administration in the smooth running of the Institutions. These pertinent roles were however not captured in the previous job evaluation exercise in 2016 which birthed the current CBA that expires in June 2021.

Ordinary teachers were therefore awarded the lowest salaries. The latest SRC job evaluation findings had rekindled their hope for better pay but the glorious moment was short-lived now that the Remuneration Commission has freezed  pay rise and increase in allowances for all civil servants, teachers included for the next two years citing financial constraints in the part of the government geared by the Coronavirus pandemic and the upcoming general elections that require a lot of money.

All eyes are now trained on the Teachers Service Commission to see what verdict it will give on this stalemate surrounding teachers’ pay rise and what plans the teachers’ unions have got in store for their members.

It will be unfortunate if teachers will be forced to revert to strikes that have dotted the education sector with solidarity songs expressing the great dissatisfaction among the workforce for the better part of the previous decade.

TSC News Today: The employment and Labour court has dismissed an appeal by a teacher’s lobby challenging the transfer of five tutors.

Delivering the ruling in Uasin Gishu, Judge John Abuodha said the Kenya National Teachers Pressure Group (KNTPG) lacked jurisdiction to lodge a case.

“The pressure group lacks jurisdiction to lodge a case in court, because it is not a trade union, a society, welfare group, political party or any of the parties permitted under the regulatory framework governing collective organisations,” he ruled.

As members of KNTPG, the five teachers, protested their transfer to Kwale, Lamu, Kitui and Homa Bay Counties by Teachers Service Commission (TSC) boss Dr Nancy Macharia.

 

In an affidavit filed in court, the group submitted that they had not written to TSC seeking the transfers to the hardship, insecure far-flung areas.

They said the move was maliciously done to punish the members for agitating for their rights on Teachers Professional Development, which TSC had violated.

Further, in the submissions, they stated that the suffering and inconveniences resulting from transfers to their families were life-threatening, inhuman, degrading and irreversible.

 

Additionally, the group alleged that TSC failed to consider distance, health, their families, and that their security was to make them resign from their jobs.

TSC disputed the group’s claims responding that the transfer from one station to another was a contractual issue regulated by the Code of Regulations for Teachers (CORT), whose terms included serving anywhere in Kenya, where the employer considered them qualified to teach.

Further, the court was informed that the commission, before the transfers, considered many factors such as equitability interest and rights of learners for quality of education competencies and the durations they have spent in their teaching stations.

In conclusion, the commission assured that the transfers were just, reasonable and non-discriminative and the allegations aforementioned lacked evidence.

At the time of filing suit, three out of five teachers had deserted duties and their proposed association being unregistered as a legal entity disqualified them to initiate a suit.

“It would, therefore, not be safe to grant interim orders sought following the group’s admission, since it is not yet a recognisable juridical person capable of benefitting from a discretionary order of the Court such as an interlocutory injunction,” Judge Abuodha said.

“It would even be more dangerous to impose an order of undertaking as to damages if it turns out the injunction was wrongfully granted because the group before the Court is a soap bubble, a phantom, so to speak. The application is hereby dismissed,” Judge Abuodha ruled.

GUIDELINES FOR RECRUITMENT OF TEACHER INTERNS  PRIMARY SCHOOLS– 2022/2023 FINANCIAL YEAR

1.0         GENERAL INFORMATION

 

  1. i) Following the advertisement for recruitment of teacher interns for Primary schools, Regional Director Nairobi, County Directors and Sub-County Directors are required to conduct a selection exercise for applicants wishing to be employed and submit Merit Lists to the TSC Headquarters. The lists should be ratified by the Regional Selection Panel for Nairobi and County Selection Panel for other counties.

 

Applicants will be required to submit their applications to the Secretary Teachers Service Commission through online platform www.teachersonline.go.ke for the county where a vacancy has been declared. Applicants will be required to scan and upload copies of professional and academic certificates together with any other relevant document as may be applicable.

 

  • The selection panel will be expected to exercise the highest degree of transparency and accountability, as stipulated in the Public Officer Ethics Act and TSC Code of Conduct and Ethics (CoCE, 2015).

 

  1. The TSC Regional Directors are required to induct TSC County Directors within their areas of jurisdiction, who in turn are expected to induct members of the Selection Panels involved in the recruitment process on the relevant Sections of the Act and the Code of Regulations for Teachers (CORT, 2015) before the commencement of the selection exercise.

 

  1. The TSC County Director MUST ensure that the recruitment proc ss is done in strict adherence to the laid down protocols by the Ministry of Health on containment of COVID – 19 pandemic.

 

 

  1. TSC County Director MUST ensure that venues for selection process are accessible to applicants with disability.

 

  • All applicants MUST be registered teachers as per Section 23( 1) of the Teachers Service Commission Act, 2012. Applicants who are not duly registered shall not be considered for recruitment.

 

  • Applicants whose names differ in the academic and professional certificates and/or identification cards MUST present an Affidavit sworn under the Oaths and Statutory Declarations Act, Cap 15 of the Laws of Kenya to explain the variance in

 

  1. Applicants who re-sat either KCPE or KCSE examinations (or their equivalents) MUST present certified copies of the certificate(s) of the national examination(s) for all attempts. Copies of Certificates must be certified by the Sub-County Directors. In the event the exam was cancelled applicants must present a letter from the Head of Institution together with a certified copy of KNEC print out from the school confirming the cancellation.

 

  1. Upon generation of Applicants’ Lists from the system by the TSC County Director, the TSC County Director shall share the lists with the TSC Sub-County Directors. The TSC Sub-County Directors shall convene the Sub-County Selection Panel(s). The Selection Panel(s) shall verify applicants’ professional, academic and any other relevant documents before shortlisting a maximum of five (5) applicants per advertised post.

 

  1. The TSC Sub-County Director shall invite shortlisted applicants for the verification of documents through a Short Messaging Service (SMS). The message shall include interview date, venue and time of the interview. The verification of documents shall be conducted at least seven (7) days from the date of The list of shortlisted applicants shall immediately be submitted to the TSC County Director who shall verify the lists, compile and submit to the TSC Regional Directors who shall in turn verify, compile and submit the lists to the HQs for publishing on the TSC website.

 

  • Following the verification exercise, the TSC Sub-County Director shall compile a Merit List of all of applicants whose documents have been verified. The Merit Lists shall be used to recruit teacher interns and any subsequent recruitment process within the financial year.

 

  • During the selection, each applicant shall be assigned a serial Applicants must present original and legible photocopies of the following, among other relevant documents: –
    1. National identification card;
    2. Certificate of Registration as a teacher;
    3. Evidence of the completion of Upgrade Diploma in Primary Teacher Education where applicable.

 

  1. PTE Certificate;
  2. KCSE certificates or its equivalent (include certificates for attempts if one re-sat exams);
  3. KCPE certificate or its equivalent (include certificates for attempts if one re-sat exams);
  4. Letter of Certification of results by KNEC (where applicable);
  5. Primary and Secondary School leaving certificates and other relevant testimonials;
  6. National Council of Persons with Disabilities (NCPWD) Card (where applicable);
  7. An Affidavit sworn under the Oaths and Statutory Declarations Act, Cap 15 of the Laws of Kenya to explain the variance in names.
  • All applicants, irrespective of gender, disability, ethnicity or Home County shall be given equal opportunities;

 

  1. Persons with disabilities shall be required to indicate their disability status together with the nature of disabilities to inform their placement;

 

  • TSC County Directors shall ensure that a 5% of all the advertised slots are reserved for the recruitment of teachers with disabilities in accordance to the provisions of the Constitution and the Law;

 

  • In the event of a tie in the ranking, consideration for selection shall be determined in the following order:
    1. Applicants’ disability status;
    2. Length of stay since graduation;
    3. Strength of academic and professional certificates

N/8: If applicants tie at PTE/DPTE Upgrade Certificate points, aggregate KCSE grades or its equivalent shall be considered.

  • The selection panel shall vet each applicant to establish if he/she meets the requirements of the TSC advertisement during the selection exercise.

 

  • Teachers who have either participated in the teacher internship programme or previously employed by the Commission are not eligible.

 

  1. Any internship contract signed based on misleading information provided by the applicant shall be cancelled immediately without any further reference to

 

  • Merit Lists generated and used during this rec;:ruitment shall be used in the subsequent replacement of teacher interns within the Financial Year or as directed by the Commission from time to time.

  • VERIFICATION EXERCISE

  • AUTHENTICATION OF ACADEMIC AND PROFESSIONAL DOCUMENTS

 

  1. Original academic and professional certificates shall be scrutinized to verify their authenticity.

 

  1. The TSC Sub County Director shall certify photocopies of the certificates and other documents before forwarding them to the TSC County

 

  • Any applicant(s) who present forged/fake academic, professional and other documents commit(s) an offence and shall be disqualified and/or deregistered.

 

  • SELECTION CRITERIA

 

  1. Applicants shall be awarded marks as per the score sheet (Appendix 1 (a) and (b).

Where applicants tie in scores, the panel shall consider the criteria under Clause 1

(xvii) of these guidelines.

Upon verification of academic, professional and other relevant documents, the Sub-County selection panel shall compile a Sub-County Merit List. The TSC Sub­ County Directors shall submit Sub-County Merit Lists to the TSC County Directors who shall convene a County Selection Panel to compile a County Merit List. The County Merit List shall be used in the subsequent recruitment processes within the financial year or as directed by the Commission from time to

  • DOCUMENTS TO BE SUBMITTED TO TSC COUNTY DIRECTOR

 

The TSC Sub County Director shall be required to submit the following to the TSC County Director: –

  1. List of all applicants who presented documents for verification at the Sub County level (Appendix II);
  2. Sub County Merit List (Appendix Ill);
  • Summary of complaints raised (if any) together with action taken;

 

  1. Minutes of the Sub-County Selection Panel duly signed by the Chairperson and Secretary clearly showing how the final list of the successful applicants was agreed upon.

 

  • COUNTY SELECTION PANEL

 

  1. After submission of Merit Lists by the TSC Sub County Directors, TSC County Director shall constitute a County selection panel comprising the following members;

  • The TSC Regional Director shall be required to convene a Regional Selection Panel to ratify the County Merit Lists and Compile Regional Merit List for submission to the TSC Headquarters within the stipulated timelines.

 

  1. The Merit Lists compiled and ratified during the selection process at the beginning of the Financial Year shall be used in subsequent recruitments within the financial year.
  • NB: It is the responsibility of the TSC County Director to ensure that the exercise is fair and transparent. TSC County Director must also ensure that all documents are in order as provided in the approved checklist and appropriately signed/certified before submission to the TSC Headquarters.

 

  • COMPLAINTS

 

  1. Any applicant who is dissatisfied with the exercise should submit to the TSC County Director a written complaint immediately and send an email to the TSC Headquarters through, dirstaffinq@tsc.qo.ke not later than seven (7) days after the selection exercise;

 

  1. The TSC County Director should, within seven (7) days of receipt of such a complaint, analyze and address all complaints raised after the selection process has been completed and thereafter submit a report to the Headquarters on the action taken.

 

  • Where an applicant is dissatisfied with the decision of the TSC County Director in

(ii) above, or where the complaint is made against the TSC County Director, the applicant shall appeal to the Appeals Committee on staffing functions at the TSC Headquarters. The Appeals Committee shall investigate the allegations and take appropriate action within fourteen (14} days.

 

  • DOCUMENTS TO BE SUBMITTED TO TSC HEADQUARTERS

The TSC County Director shall submit the following to the TSC Headquarters;

 

  1. County Selection Panel minutes duly signed by the Chairperson and Secretary;
  2. Copies of minutes of the Sub-County Selection Panel duly signed by the Chairperson and Secretary and verified by the TSC County Director on behalf of the County Selection Panel, clearly showing how the final list of the successful applicants was agreed upon;
  • County Merit Lists; (Appendix IV)
  1. List of all selected applicants drawn from the County merit list; (Appendix VJ
  2. List of all invited applicants who did not appear for verification; (Appendix VJ);
  3. List of applicants with disability; (Appendix VII)

  1. All enquiries arising from these guidelines should be made to the TSC County Director.
  • Notwithstanding the decentralization of the function of teacher recruitment pursuant to Section 20 of the TSC Act, the Commission is not precluded from carrying out recruitment directly from the TSC Headquarters.
  1. The TSC Regional Directors shall:
    1. Ensure guidelines are adhered to within their regions;
    2. Coordinate the teacher internship recruitment process within their respective regions;
    3. Sensitize County Directors and oversee the sensitization of other officers including members of the BoM involved in the process;
    4. Undertake measures to resolve complaints arising from the process within their regions;
    5. Confirm and ratify County Merit Lists
    6. Compile and submit Regional Merit Lists to the TSC

In June 19, 2019, a section of Kenyan TSC employed female teachers lamented over ambushed deductions emanating from the newly founded KEWOTA union.

According to the affected female teachers, the TSC T-Pay portal had failed to protect their salaries from unauthorized deductions by KEWOTA.

This article seeks to provide a step by step guide on how TSC employed teachers can withdraw from KNUT, KUPPET or KEWOTA to avoid unnecessary multiple deductions.

Is it a must for a TSC employed teacher to join a union?

I know that this may be the big question racing through your mind right now especially if you have ever been deducted union dues without your consent or if you are “green” having been recently employed by the Teachers Service Commission.

My honest response is that unions are a necessary evil in your life as a teacher.
They come in handy when things go south that is when you have been interdicted or charged in a law of court.

The unions can extend their protective wings to shield you from the hailstones.
However, you do not need to be a member of all the three unions-KUPPET, KNUT and KEWOTA simply because their roles are more or less the same.

Some of the roles that Teachers’ Unions play include:

1. Uniting teachers from all walks of life in Kenya and providing a forum for co-operation.

2. Improving Kenyan teachers’ welfare and/ or socioeconomic status.

3. Aiding members in professional and legal matters.

4. Forging for improved terms and conditions of service for teachers and promoting the interests of teachers.

5. Settling disputes that may pop up between their union members or between members and their employer that is the Teachers Service Commission, TSC.

6. Working with other unions, bodies, societies and organizations within or outside Kenya.

7. Participating actively in the process of policy formulation in matters of education.

How to withdraw from unions (KUPPET, KNUT or KEWOTA) through the TSC online T-Pay Portal

If you would like to therefore avoid unwarranted union deductions from your TSC online payslip, follow these simplified steps to withdraw:

1. Log onto the official TSC online payslip portal, T-Pay by clicking on the following link

2. Click on the tab labelled “3rd party self-service module.”

3. After clicking on the tab, a new window will load with the following heading “Running Transaction Details.”

4. From the window provided, identify the union you would like to withdraw from that is either KEWOTA, KUPPET or KNUT then click on “Stop transaction(s).”

5. Once you click on “STOP TRANSACTION” you are free from those multiple union deductions.

NOTE: AFTER WITHDRAWING FROM KNUT, KUPPET OR KEWOTA THROUGH THE OFFICIAL TSC T-PAY PORTAL, ENSURE THAT YOU SEND A HANDWRITTEN COPY TO THE TSC FOR FILING.

The Teachers Service Commission occasionally collects data on its employees including teachers touching on their length of stay in one working station-school which forms the basis for massive TSC delocalization.

The latest TSC delocalization, mass transfer of teachers news 2021 however indicates that the Commission will henceforth carry out teacher delocalization in a more synchronized manner to preserve the family, the basic unit of any society.

This follows a public outcry from the affected teachers who were separated from their families by previous TSC delocalization exercises.

How CBA 2021-2025 will affect TSC Mass Delocalization of Teachers

Teachers whose families were separated following mass transfers that were executed by the commission have something to smile about in the new 2021-2025 collective bargaining agreement (CBA).

The commission noted that the move is set to promote family values. However, these transfers will be subject to the availability of vacancies among other requirements.

“In promoting family values, the commission agreed to consider requests for transfer of couples who are teachers, subject to availability of vacancies among other requirements,” reads the CBA in part.

Collins Oyuu, the newly elect Kenya National Union of Teachers (KNUT) Secretary general lauded the move as the biggest gain in the latest CBA that has been castigated owing to its lack of monetary component.

Mr. Oyuu noted that families that had been separated will be reunited once the commission kicks off the implementation of the deal.

He said: “Families have suffered in most of the transfer cases. These families that were moved apart due to the transfers will now be reunited once the TSC starts to implement the deal,”.

Kuppet secretary-general, Okello Misori, commended the move as a major win especially for teachers who are nearing retirement.

“Some of these teachers are nearing retirement. Bringing them close to each other will be a good move. Some are also having health issues and being close to family is a major win,” said Mr. Misori.

TSC started mass transfer of teachers on January 1, 2018. The exercise received tremendous opposition from KNUT. Secondary school heads were the most affected.

While appearing before National Assembly, Chief Executive Officer Nancy Macharia defended delocalization noting that it will promote co-existence and cohesion in different communities across the country.

“The overall objective of this policy is to deter over-localisation of the teaching profession to promote co-existence and cohesion among different communities,” Dr. Macharia said.

TSC Reviews Recruitment Roadmap For Advertised Vacancies; Deadline, Interviews Dates and Venues,Posting Letters 2023 Reporting Dates

The Teachers Service Commission, TSC, has released a new recruitment roadmap or rather schedule for 35, 550 newly advertised vacancies for teachers on permanent and pensionable terms and internship.

According to the reviewed roadmap, online application that kicked off on Saturday 10th December, 2022 will run up-to Friday 23rd  December, 2022, an extension from December 16, 2022 application deadline.

Generation of Applicants’ Lists, shortlisting by the County Selection Panel and invitation for interviews will take place between Thursday 29th December, 2022  and Thursday 5th January, 2023.

After applicants’ lists have been generated publication will be done on Friday  13th January, 2023.

A seven-day-county recruitment exercise will take place between Friday 13th January, 2023 and Monday 23rd  January, 2023.

Vetting at County Level , Handling of Complaints,  Signing of Internship Agreements, Offer of Internship Letters & Signing of Offer of Employment Letters will take place between Tuesday 24th January, 2023 – Tuesday.

Successfully recruited Teachers and Teacher Interns will report to their schools on Wednesday 1st February, 2023.

TSC TRANSFER APPLICATION FORM

This form is filled by a teacher who wishes to change his/ her current work station. The form enables the commission to consider a teacher’s intra and inter county transfer request. The reason for seeking the transfer must be satisfactory enough to warrant the transfer. Such reasons as ‘on medical grounds’ with supportive evidence is presumably given much weight by TSC. The TSC promotion form is for common cadre promotions. It is filled by teachers who have successfully served the required number of years in a given job grade. The form is filled by the head of institution. It is good to get the form ready and sent to TSC three months prior the expiry of the required minimum number of years that a teacher is to serve in the job group.
