The teachers’ employer, TSC will execute a major shake up in the administration of public primary and secondary  schools,  mixed schools being the main target in  April.

The upcoming TSC teachers transfers have been propelled by the formulation of a new policy by the Commission to ensure mixed schools’ heads and their deputies are not of the same gender which will be implemented once KCSE and KCPE exams are over.

TSC LATEST NEWS TODAY-The Teachers Service Commission (TSC) is planning a major shake up in schools’ administration after this year’s national examinations. This is after the Commission adopted a new policy that will govern deployment of administrators.

According to the new policy, principals and deputies of mixed schools are not supposed to be of the same gender.

TSC Boss, Dr. Nancy Macharia, has directed all the TSC Regional Directors implement the policy that is aimed at fostering inclusivity in public schools. She directs regional directors are to liaise with the county directors who are to identify mixed schools that have heads and deputies of same gender and subsequently place the deputies appropriately after the national examinations.

“Identification and deployment of institutional administrators is premised on career progression guidelines and the policy on appointment and deployment of institutional administrators (2017). The process is underpinned on values and principles of governance which include but not limited to: equity, equality, inclusiveness, non-discrimination and affirmative action,” Macharia says in a circular addressed to all Regional TSC Directors.

Mixed schools with Principals who both are of the same gender will see one of them getting the marching orders. Macharia wants the list of the heads and deputies sent to her before April 30 once the placement is completed. This will lead to massive transfers of the affected administrators; mostly deputies.

TSC rolls out new gender- based delocalization policy 

Implementation of this new policy follows the commission’s research findings that showed a majority of the mixed schools in the country having heads and deputies of the same gender.

Macharia says a scenario where both heads and deputies are of the same gender leads to unprecedented gender imbalances in the learning institutions.

“The scenario neither fosters gender-inclusive learning environment nor provides a supportive atmosphere for all learners…Accordingly, to ensure a supportive learning environment for learners of both gender the commission’s policy is to appoint and deploy administrators of applicable gender to head and deputise learning institutions,” notes Dr.Macharia.

This policy will supplement the contentious delocalization exercise that has seen thousands of heads and their deputies moved away from home counties.

Good news for teachers currently employed either on contractual or permanent and pensionable terms by the Teachers Service Commission, TSC Kenya as MPs forge for payment of fees for the newly introduced TSC TPD Modules 2022.

TSC teachers have finally breathed a sigh of relief after news pointing towards a possible solution for the stalemate concerning the payment for the new refresher modules rolled out by their employer in readiness for the roll out of the Competence-based curriculum emerged.

 

Reliable sources now indicate that Members of the august house have asked the Teachers Service Commission (TSC) to organise a legal documents that will facilitate the government to pay annual refresher training fees for tutors.

 

Omboko Milemba, who is also Kenya Union of Post Primary Education Teachers (Kuppet) chairman said the money ought to be paid by the State through TSC.

 

“TSC should now go back to prepare a legal document that led to the TPD programme, explain how the training fees was arrived at and also make a requisition for that money,” said Milemba.

 

 

 

National Assembly Education Committee members put TSC Chief Executive Nancy Macharia to task for not including the money as a budgetary requirement.

 

Macharia was also asked to explain how the training fees was arrived at, as MPs argued that even school fees and university fees are highly regulated.

 

We want to know why TSC has not factored in this money in its budget statement so that it can be an independent budget line funded by the government,” said Florence Mutua, chairperson of the committee.

 

MPs asked Macharia to prepare and submit a legal framework that would enable government foot the training bills. She had appeared before MPs to defend TSC budget requirements.

 

MPs argued that all levies are determined by Parliament and sought to know the formula used by TSC to cap the training fees. Macharia said the TPD is anchored in law under Section 35(2) (a) of the TSC Act.

 

Each of the 340,000 teachers are required to undertake mandatory professional courses that will inform their promotion and professional growth.

 

The refresher courses dubbed Teacher Professional Development (TPD) have been organised into chapters that will be taken every year at a cost of Sh6,000.

 

This means that in an entire teaching career, each teacher will be required to take five modules within 30 years, translating to fees of about Sh180,000.

Education Committee reviews Education Act to affect non-teaching/ Support staff

A legislative proposal seeking to amend the Basic Education Act, 2013 is undergoing pre-publication scrutiny by the National Assembly Committee on Education.

The proposed Basic Education (Amendment) Bill, 2025, sponsored by Hon. John Waluke, seeks to enhance transparency by requiring non-teaching staff to declare their wealth and by aligning school audits with the Public Audit Act.

One proposed amendment would require non-teaching staff to declare their income, assets, and liabilities, as well as those of their spouses and dependents.

The Committee Members noted the misuse of funds particularly infrastructure funds in public schools. Hon. Nabii Nabwera advocated for a clear separation of financial and academic roles within schools.

“Let the teacher be the teacher, teach and manage the academics and we have a professional manager and a qualified administrator actually dealing with issues of money with schools, resources and procurement,” Hon. Nabwera stated.

The Committee questioned why a ministry allocates money to public schools that would be entrusted to individuals who may lack proper qualifications and are not held accountable by any regulations.

Hon. Eve Obara and Hon. Mary Emaase called on the Ministry to develop a mechanism to ensure accountability from bursars and other non teaching staff.

The Bill also seeks to mandate that school audits align with the Public Audit Act.

However, committee analysis pointed out that the Basic Education Act and the Public Finance Management Act already provide comprehensive frameworks for the audit and management of public funds, including penalties for non-compliance.

In the meeting, chaired by Hon. Julius Melly, the Committee also engaged representatives from the Office of the Auditor General on Performance Audit Reports for the Ministry of Education on Management of Development Funds for Technical Institutions, March 2018; the Implementation of the National School Upgrading Program, March 2018 and Expansion, Improvement and Maintenance of Infrastructure in Public Primary Schools by the Ministry of Education, November 2021.

The Teachers Service Commission is consequently analyzing data for principals serving within their home counties and those who have served in the same school for over nine years.

The TSC is set to delocalize school heads and other school administrators in November/ December, 2019.

In June 2019, the Teachers Service Commission directed all county Directors to collect data on school administrators in readiness for the transfers.

This was done through a memo dated 27th June, 2019 by Dr Dorothy Owuor, the TSC Deputy Director in charge of Staffing.

The Teachers Service Commission is consequently analyzing data for principals serving within their home counties and those who have served in the same school for over nine years.

The Commission received the data at the headquarters in Nairobi by 8th July 2019.

NO DELOCALIZATION
Dr Nancy Macharia, the TSC Chief Executive Officer, has confirmed that teachers with medical conditions will not be affected by the delocalization process.

Teachers who have attained the age of 56 years will also be spared.

According to private sources, the TSC is finalizing the transfer letters for the heads who have been affected by the exercise.

The letters will be dispatched in late November or early December.

THE RATIONALE BEHIND THE DELOCALIZATION PROCESS
According to the TSC, delocalization is being undertaken due to the following reasons:

1. To fill the slots of principals and heads who have attained the mandatory retirement age. This means deputy principals and deputy heads with the required qualifications and outstanding performance will be promoted and transferred to their new stations of work. Some principals have also been transferred to fill the vacancies left to better performance and utilize the experience they have garnered in their new work stations.

2. To strengthen management in some learning institutions as per the recommendations of the standards and assessment reports.

3. To implement the policy which regulates the appointment of institutional administrators. According to the policy, administrators who have served for too long should be transferred to enable the new work stations tap into their wide experience.

NEW DELOCALIZATION DATES
The Teachers Service Commission in April transferred few school administrators to avoid disruption of curriculum implementation.

The Commission now prefers delocalizing Administrators in December as opposed to August and April to facilitate a smooth transition and reduce disruptions.

KNUT has vehemently opposed the massive delocalization exercise saying it should be carried out with some bit of humanity.

The ongoing TSC delocalization exercise has attracted mixed reactions after some heads who were recently delocalized from their home counties were transferred again. According to the Daily Nation, some heads who had barely served in their new schools due to delocalization were delocalized again in December 2019.

Some Deputy Principals have however received the December 2019 TSC delocalization news with a broad smile after they were promoted to head various schools.

Majority of the teachers affected by the TSC 2019 delocalization exercise have served the same school for a very long time.

Principals who have served the same school for over 9 years and deputies who have served the same institution for at least 6 years were delocalized.

Heads of primary schools across Kenya have started receiving their letters directing them to report to their new schools next week.

It is now officially confirmed that the Teachers Service Commission (TSC) plans to employ at least 6,000 intern teachers by December 2021.

 

Reporting Dates for TSC Intern Teachers -January 2022

 

Teachers who will get successfully recruited are expected to report to their new working stations within the first two weeks of third term- by January 14, 2022 to ensure a smooth transition and effective implementation of the new Competence-Based Curriculum CBC.

 

Posting Dates and Letters for Intern Teachers 2022

According to verifiable sources, the recruited teachers will be expected to take their internship posts early January when they will be posted to schools.

According to TSC Chief Executive Nancy Macharia the additional employees would ease teachers’ workload as enrollment rises, particularly due to the government’s 100 per cent transition from primary to secondary school policy.

 

This is a commendable government effort to ensure quality learning and teaching in our public schools,” said Macharia.

Macharia said the recruitment of 6,000 teachers on internship will cost the Commission kshs 1.2 billion.

She said TSC is more concerned with the workload brought by the 100 per cent transition policy and commended the government for allocating more funds for recruiting more teachers.

“We appreciate the government for allocating TSC funds annually for the recruitment of additional teachers since the 100 per cent transition programme was launched,” said Nancy Macharia.

 

However of the 6,000 internship vacancies only 2,000 will go to primary schools while the rest 4,000 will be reserved for secondary schools.

Interview Dates and Venues for TSC Internship Vacancies (6000)

The TSC Internship recruitment  exercise will begin on December 20, 2021 and run for 10 days up to 30th December when the current internship contract expires.

 

Previous TSC  Internship Recruitment Vacancies

Last year TSC recruited 12,000 intern teachers under the Covid-19 economic stimulus package at a cost of Sh2.4 billion.

Secondary schools intern teachers earn a stipend of Sh 20,000 per month while interns in primary schools take home Sh15,000.

 

In July 2021 TSC advertised a total of 3,914 replacements for primary and secondary schools to replace teachers who exited Service. The recruitment will start on 20th December and end on 30th December when the current internship contract expires.

TSC also advertised 5,000 teaching posts for secondary schools. However 1,000 posts went to practicing P1 teachers who have bachelors degree with C+ in KCSE and C+ in the two teaching subjects to be deployed to teach in secondary schools.

The recruited teachers have started to receive their posting letters where they will work on permanent and pensionable terms.

In the last recruitment TSC gave priority for intern teachers to be employed on permanent terms. In the recruitment score sheet the Commission awarded 30 marks to all intern teachers despite the period they had served.

This caused an uproar from a section of teachers who termed it a discrimination exercise. Some unlucky intern teachers were unable to secure employment on permanent terms and are currently serving under internship contract others for a second year now.

Macharia said the July recruitment brought the total number of teachers hired since 2018 to facilitate the 100 per cent transition policy to 28,700.Currently TSC has a total of 330,671 teachers employed.

Upon invitation for interview for Secondary school internship, applicants will be expected to appear with originals and clear copies of the following documents

1) National Identification card;

2. National Council of Persons with Disability (NCPWD) Card (where applicable);

3) KCPE certificate or its equivalent (include certificates for attempts if one repeated exams);

4) KCSE certificates or its equivalent (include certificates for attempts if one repeated exams);

5) Diploma/Degree certificate and official transcripts;

6) Certificate of Registration as a teacher;

7) Sworn Affidavit where names appearing on the submitted documents differ;

8) Primary and Secondary School leaving certificates and other relevant testimonials.

For one to be eligible for recruitment as a Graduate Intern teacher, the applicant must have a minimum mean grade of C+ (plus) at KCSE and C+ (plus) in each of the two teaching subjects or two (2) Principles and one (1) Subsidiary pass at ‘A’ Level.

In addition, they must have:

1) A Bachelor of Education Degree with two (2) teaching subjects.

2) A Bachelor of Science or Arts Degree plus a Post Graduate Diploma in Education (PGDE) with two teaching subjects.

3) Bachelor of Science with Education/Bachelor of Arts with Education with two teaching subjects.

4) Bachelor of Education holders with Mean Grade of C (Plain) and C (Plain) in the two teaching subjects at KCSE and have undertaken a Diploma in Education or gone through the A-Level system in the relevant area(s) are eligible.

5) Bridging/Pre-university certificates for those who completed the course before December 31st 2015 may be considered.

Graduate Teacher Interns should have studied a minimum of eight (8) course units in each teaching subject.

Applicants presenting enhancement certificate(s)/official transcripts in teaching subject(s) from recognized institution(s) qualify for employment if they scored at least a C+ (Plus) in the enhanced subject at KCSE.Applicants previously employed under contract and whose services were terminated due to inadequate units in teaching subjects and have since obtained enhancement certificates with adequate units are eligible to apply.

Applicants applying for computer studies MUST have taken teaching methods course in the subject.

For applicants trained in Special Needs Education, Kenya Sign Language (KSL) or Braille will be considered as “teaching subjects”. Such will, for instance include Biology/KSL and Geography/Braille etc.

However Applicants whose training is in subjects that are currently not in the Curriculum do not qualify, irrespective of the Post Graduate Diploma in Education (PGDE) or enhanced qualifications they may possess.

This category includes, but not limited to Bachelor of Science/Bachelor of Arts in: Natural Resources, Meteorology, Forestry, Animal Husbandry, Horticulture, Farm Machinery, Fisheries, Anthropology, sociology, Theology/Divinity, Journalism etc.

TSC-LETTER-OF-PROBATIONARY-EMPLOYMENT

The Teachers Service Commission, TSC, sends a letter of employment (Letter of probationary employment) to a newly recruited teacher after successfully vetting the teachers’ documents. The letter is sent to the teacher through the station where the teacher has been posted to serve under TSC terms. In the letter the Commission Secretary spells out the entry level of the teacher i.e Secondary School Teacher II for teachers entering the profession as degree holders. The station where the teacher has been posted and the subjects to be handled are also written on the employment letter.

TERMS OF EMPLOYMENT.

A newly recruited teacher works on probation for a period of not less than six (6) months. In some cases the probation period may be extended if the teacher’s performance is unsatisfactory; at worst, the teacher’s employment may be terminated before completion of the probation period. To be confirmed on permanent terms, the head of institution fills a recommendation form for the teacher that is sent to TSC for approval.

The teacher is expected to proceed to the posted institution as indicated on the employment letter and has a grace period of 30 days from the effective date; as stated on the letter.

The employment letter also spells out the expected basic salary per year depending on the entry grade of the teacher. The teacher is also entitled to monthly allowances pegged on his/ her grade. Allowances that the teacher may get include, but not limited to: House allowance and Commuter allowance. Teachers working in areas classified as hardship get hardship allowance on top of the two allowances. While, those working at schools with differently abled learners also receive Special allowance.

The teacher is expected to work in any part of the country where the Commission feels his/ her services are required. Additionally, the teacher will have to serve at the initial work station, where the first posting has been made, for a period of not less than five (5) years before requesting for a transfer. Though, in some cases such a teacher may be transferred under special consideration from the Commission on such grounds as Medical and insecurity; as may be deemed fit by TSC.

The employment letter is also copied to the Principal or head of institution and the TSC County Director.

2020 KCSE & KCPE EXAMS CANCELLED: EDUCATION BREAKING NEWS

There will be no national exams for candidates in the year 2020.

This follows CS Magoha’s announcement today at the KICD offices at a press briefing on the reopening of schools and the new school calendar for the year 2020.

This, therefore, means that all candidates who had registered with the Kenya National Examinations Council, KNEC to sit for the Kenya Certificate of Secondary Education, KCSE, and the Kenya Certificate of Primary Education, KCPE will have to repeat classes when learning resumes in January 2021.

The decision was arrived at after several consultations involving key education stakeholders and representatives from the Ministry of Health.

2020 SCHOOL CALENDAR/ACADEMIC YEAR

CS Magoha also said that the 2020 school calendar has been written off following the unprecedented spike in the number of coronavirus cases in the country.

Present at the press briefing were union officials led by KNUT Secretary General Wilson Sossion, KUPPET Secretary General Akello Misori, TSC CEO Dr. Nancy Macharia, and the Kenya Parents Association Boss Nicholas Maiyo.

All the afore-mentioned stakeholders were given a chance to express their opinions on the matter before the CS addressed the nation.

The stakeholders backed the education ministry’s move to extend the schools’ reopening date until January 2021, when the covid-19 curve would have flattened.

TVET institutions and colleges were however allowed to reopen in September but they will have to strictly adhere to the given guidelines first.

“All institutions allowed to reopen must comply with covid-19 regulations or risk closure,” said the CS.

INTERNATIONAL SCHOOLS

The new school calendar applies to international and private schools too.

Most international schools have been facilitating online classes for their learners through Zoom and Google classrooms with the hope that schools will reopen soon.

This has been a source of conflict between the schools and parents who feel that they should not meet the cost of online learning.

Now that the CS has announced a new academic calendar for schools offering international curriculum, the schools and parents will have to reach a middle ground in as far as the payment of school fees is concerned.

NANCY MACHARIA’S FIRST SPEECH

The newly reappointed TSC CEO Dr. Nancy Macharia was also given a chance to speak today on behalf of the Teachers Service Commission.

The CEO appreciated the crucial roles played by teachers in the education sector.

She thanked them for their continued support in ensuring that learners access content virtually.

She further insisted that the Commission is concerned about the safety of both learners and teachers.

Dr. Macharia categorically stated that there is no way the Commission can allow teachers to resume duty before proper psychological preparation.

Besides, teachers who have clocked 58 and those with underlying medical conditions such as diabetes who are classified as vulnerable will have to be taken care of before schools reopen.

2022/2023 TSC  LATEST GUIDELINES FOR RECRUITMENT OF TEACHERS ON PERMANENT & PENSIONABLE TERMS – PRIMARY SCHOOLS – 2022/2023 FINANCIAL YEAR

TSC Recruitment Vacancies per County and Region

1.0      GENERAL INFORMATION

  1. Following the advertisement for recruitment of teachers for Primary schools on permanent and pensionable terms, Regional Director Nairobi, County Directors and Sub-County Directors are required to conduct a selection exercise for applicants wishing to be employed and submit Merit Lists to the TSC The lists should be ratified by the Regional Selection Panel for Nairobi and County Selection Panel for other counties.

 

  1. Applicants will be required to submit their applications to the Secretary Teachers Service Commission through online platform teachersonline.go.ke for the county where a vacancy has been declared.

 

  • The selection panel will be expected to exercise the highest degree of transparency and accountability, as stipulated in the Public Officer Ethics Act and TSC Code of Conduct and Ethics (CoCE, 2015).

 

 

  1. The TSC Regional Directors are required to induct TSC County Directors within their areas of jurisdiction, who in turn are expected to induct members of the Selection Panels involved in the recruitment process on the relevant Sections of the Act and the Code of Regulations for Teachers (CORT, 2015) before the commencement of the selection

In the event the exam was cancelled applicants must present a letter from the Head of Institution together with a certified copy of KNEC print out from the school confirming the cancellation.

 

  1. Upon generation of Applicants’ List from the system, the TSC County Director shall convene the County Selection Panel which shall shortlist a maximum five (5) applicants per advertised post, by Sub County, after considering all

    7. Letter of Certification of results by KNEC (where applicable);
    8. Primary and Secondary School leaving certificates and other relevant testimonials;
    9. National Council of Persons with Disabilities (NCPWD) Card (where applicable);
    10. An Affidavit sworn under the Oaths and Statutory Declarations Act, Cap 15 of the Laws of Kenya to explain the variance in

 

  • All applicants, irrespective of gender, disability, ethnicity or Home County shall be given equal opportunities;

 

  1. TSC County Directors shall ensure that a 5% of all the advertised slots are reserved for the recruitment of teachers with disabilities in accordance to the provisions of the Constitution and the Law;

 

  • The Commission shall allocate additional slots for ASAL and Hard to Staff areas based on the recorded teacher

 

  • In the event of a tie in the ranking, consideration for selection shall be determined in the following order:
    1. Applicants’ disability status;
    2. Participation in the TSC Teacher Internship Programme;
    3. Length of stay since graduation;
    4. Strength of academic and professional certificates

N/B: If applicants tie at PTE/DPTE points, aggregate KCSE grades or its equivalent shall be considered.

  • The details of the shortlisted candidates shall be posted in the TSC Website at least Seven (7) days before the date of the selection exercise

 

  • The selection panel shall vet each applicant to establish if he/she meets the requirements of the TSC advertisement during the selection

 

  1. Preference shall be given to applicants who have never been employed by the

 

  • The merit list shall be used in the subsequent recruitment processes in the County within the Financial Year or as directed by the Commission from time to

 

2.0.     SUB-COUNTY SELECTION PANEL

The Selection Panel shall comprise of the following members: –

  1. The Sub County Director –         Chairperson
  2. TSC Sub County Human Resource Officer –         Secretary
  • Zonal Curriculum Support Officers (3) –         Members

               VERIFICATION EXERCISE

  1. The TSC Sub County Director shall verify the TSC registration status of all applicants;
  2. The TSC Sub County Director shall present a list of all applicants to the Selection Panel;
  • Applicants must appear in person before the Selection Panel on the set

 

  AUTHENTICATION OF ACADEMIC AND PROFESSIONAL DOCUMENTS

  1. Original academic and professional certificates shall be scrutinized to verify their

 

  1. The TSC Sub County Director shall certify photocopies of the certificates and other documents before forwarding them to the TSC County

 

  • Any applicant(s) who present forged/fake academic, professional and other documents commit(s) an offence and shall be disqualified and/or

 

               SELECTION CRITERIA

  1. Applicants shall be awarded marks as per the score sheet (Appendix 1(a) and (b).

Where applicants tie in scores, the panel shall consider the criteria under Clause 1

(xvii) of these guidelines.

 

  1. Upon verification of academic, professional and other relevant documents, the Sub-County selection panel shall compile a Sub-County Merit List. The TSC Sub- County Directors shall submit Sub-County Merit Lists to the TSC County Directors who shall convene a County Selection Panel to compile a County Merit The County Merit List shall be used in the subsequent recruitment processes within the financial year or as directed by the Commission from time to time.

 

  1. An applicant with disabilities related to hearing and/or speech shall be allowed the company of a sign language interpreter.

 

               DOCUMENTS TO BE SUBMITTED TO TSC COUNTY DIRECTOR

The TSC Sub County Director shall be required to submit the following to the TSC County Director: –

  1. List of all applicants who presented documents for verification at the Sub County level (Appendix II);
  2. Sub County Merit List (Appendix III);
  • Summary of complaints raised (if any) together with action taken;
  1. Minutes of the Sub-County Selection Panel duly signed by the Chairperson and Secretary clearly showing how the final list of the successful applicants was agreed

 

              COUNTY SELECTION PANEL

  1. After submission of Merit Lists by the TSC Sub County Directors, TSC County Director shall constitute a County selection panel comprising the following members;

 

  1. TSC County Director –         Chairperson
  2. TSC Deputy County Director –         Secretary
  3. County Human Resource Officer –         Member
  4. TSC Sub County Director (2)                –         Members

The TSC County Director MUST ensure that the Ministry of Health COVID-19 containment measures or any other pandemic as may be advised by the Ministry of Health are adhered to by both panel members and the applicants at all times.

  1. The TSC County Director shall be required to convene a County Selection Panel to ratify Sub County Merit Lists and compile the County Merit List for onward submission to the TSC Headquarters within the stipulated timeline;
  • The selected applicants from the Merit List shall be informed through Short Message Service (SMS) and will be required to correctly fill the TSC Application for Employment Form (TSC/APPT/1) without erasing or defacing
  1. The Merit List compiled and ratified during the selection process at the beginning of the Financial Year shall be used in subsequent recruitments within the financial

NB: It is the responsibility of the TSC County Director to ensure that the exercise is fair and transparent. TSC County Director must also ensure that all documents are in order as provided in the approved checklist and appropriately signed/certified before submission to the TSC Headquarters.

 

       COMPLAINTS

 

  1. Any applicant who is dissatisfied with the exercise should submit to the TSC County Director a written complaint immediately and send an email to the TSC Headquarters through, dirstaffing@tsc.go.ke not later than seven (7) days after the selection exercise;

 

  1. The TSC County Director should, within seven (7) days of receipt of such a complaint, analyze and address all complaints raised after the selection process has been completed and thereafter submit a report to the Headquarters on the action

 

  • Where an applicant is dissatisfied with the decision of the TSC County Director in

(ii) above, or where the complaint is made against the TSC County Director, the applicant shall appeal to the Appeals Committee on staffing functions at the TSC Headquarters. The Appeals Committee shall investigate the allegations and take appropriate action within fourteen (14) days.

 

              DOCUMENTS TO BE SUBMITTED TO TSC HEADQUARTERS

 

The TSC County Director shall submit the following to the TSC Headquarters;

  1. County Selection Panel minutes duly signed by the Chairperson and Secretary;
  2. Copies of minutes of the Sub-County Selection Panel duly signed by the Chairperson and Secretary and verified by the TSC County Director on behalf of the County Selection Panel, clearly showing how the final list of the successful applicants was agreed upon;
  • County Merit Lists; (Appendix IV)
  1. List of all selected applicants drawn from the County merit list; (Appendix V)
  2. List of all invited applicants who did not appear for verification; (Appendix V1);
  3. List of applicants with disability; (Appendix VII)
  • Duly filled Application for Employment Forms (TSC/APPT/I) for the selected applicants;
  • Original statement of confirmation of PTE/DPTE/KCSE/KCPE results from KNEC for applicants without original certificates;
  1. Original Medical Examination report in form GP 69;
  2. Certified copies of the following documents in the order indicated below: –
    1. National identification card;
    2. Certificate of Registration as a teacher;
    3. Authentic evidence of service as a teacher intern (where applicable);
    4. PTE/DPTE certificate;

  1. Merit Lists shall be made available to members of public wishing to see them on request in a manner that will not put the recruitment process into

  • All enquiries arising from these guidelines should be made to the TSC County

iv)         Notwithstanding the decentralization of the function of teacher recruitment pursuant to Section 20 of the TSC Act, the Commission is not precluded from carrying out recruitment directly from the TSC Headquarters.

  1. The TSC Regional Directors shall:
    1. Ensure guidelines are adhered to within their regions;
    2. Coordinate the teacher recruitment process within their respective regions;
    3. Sensitize County Directors and oversee the sensitization of other officers including members of the BoM involved in the process;
    4. Undertake measures to resolve complaints arising from the process within their regions;
    5. Ratify Merit Lists submitted by the TSC County

TSC posts intern teachers as more lined up for employment

The Teachers Service Commission (TSC) has started to post intern teachers it recruited this month to schools.

Though there were rumours TSC would delay and post the recruited teachers in January 2022, sources have revealed a plan to post more teachers starting next week.

The Commission advertised 1,995 teacher internship posts in September 2021 where 1,038 posts went to primary schools and 957 posts to secondary schools.

TSC said the recruitment of the intern teachers was in support of the Governments initiative to develop a pool of young talents for the Kenyan Labour Market.

TSC Internship programme is a short term programme lasting one year that supports efforts by teacher training institutions to equip and sustain the competencies of persons entering teaching service.

Interns attached to primary schools get a monthly stipend of Kshs. 15,000/= while those in secondary schools get Kshs. 20,000/=.

The recruitment of intern teachers is meant to address severe teacher shortage in schools.

TSC also extended internship for 4,005 teachers whose one year term was to end in December 2021.

The Commission had outlined its plan of employing at least 6,000 intern teachers by December 2021.

According to TSC Chief Executive Nancy Macharia the additional employees would ease teachers’ workload as enrollment rises, particularly due to the government’s 100 per cent transition from primary to secondary school policy.

“This is a commendable government effort to ensure quality learning and teaching in our public schools,” said Macharia.

Macharia said the recruitment of 6,000 teachers on internship will cost the Commission kshs 1.2 billion.

She said TSC is more concerned with the workload brought by the 100 per cent transition policy and commended the government for allocating more funds for recruiting more teachers.

“We appreciate the government for allocating TSC funds annually for the recruitment of additional teachers since the 100 per cent transition programme was launched,” said Nancy Macharia.

However of the 6,000 internship vacancies only 2,000 will go to primary schools while the rest 4,000 will be reserved for secondary schools.

Last year TSC recruited 12,000 intern teachers under the Covid-19 economic stimulus package at a cost of Sh2.4 billion.

During the recruitment TSC highlighted the following requirements for one to be eligible for internship.

ELIGIBILITY FOR INTERNSHIP

To qualify, an applicant must at the time of application meet the following basic requirements:

a) Be Kenyan citizen;

b) Must be a registered teacher with Teachers Service Commission;

c) Be a holder of a P1 Certificate for Primary Schools and a minimum of a Diploma in Education Certificate for Secondary Schools;

d) Hold original academic and professional certificates;

e) Should not have been in previous employment with the Commission, as a teacher on permanent terms;

f) Must not have served as teacher intern under TSC (teacher) Internship Programme;

g) Be ready to be posted to any public educational institution in Kenya;

h) Must have a Personal Accident Insurance to cover for personal risks during the internship period.

In addition to the above, successful applicants shall be required to produce;

a) A copy of the National Identity Card (ID) or Passport Certificate;

b) A copy of Teacher Registration Certificate/ print-out from TSC portal evidencing registration as a teacher;

c) A copy of NCPWD card (where applicable);

d) A valid Certificate of Good Conduct;

e) Two (2) coloured passport size photographs;

f) A copy of NHIF card;

g) A copy of KRA PIN.

Tension has reigned supreme at the TSC headquarters following the latest declaration made by KUPPET boss this week. According to Akelo Misori, more than 242,000 teachers who have been contracted by Knec to invigilate, supervise and mark the 2021 KCSE and KCPE national exams set to be conducted this March/ April may down their tools and paralyze the exams this year if the salary raise demands are not met by TSC.

Teachers have threatened to strike in response to their employer’s failure to honor their Collective Bargaining Agreement (CBA), a move that could jeopardize national exams scheduled for March.

The Kenya Union of Post Primary Education Teachers (KUPPET) issued a strike notice on Wednesday, February 23, after their demand for new salary negotiations failed to take off.

The teachers’ representative argued that the seven-day strike notice would be implemented if the Teachers Service Commission (TSC) refused to reopen negotiations on their 2021-2025 CBA.

According to KUPPET Secretary-General Akello Misori, the union wrote to TSC on January 17 demanding that the CBA be reopened within 21 days.

“Upon the expiry of the 21 days, the union said it would review the commission’s response before convening its organs to give further directions on the next course of action,” Misori stated

He added, “all the commission has done is to acknowledge our letter and promise to respond at a later stage after ‘interrogating’ the contents.”

TSC’s failure to engage them, according to the KUPPET Secretary-General, has forced them to call for mass action.

In the CBA, the union proposed a 30% to 70% raise for all teachers in the country.

“In the absence of a clear-cut commitment to re-open the talks, we have no idea how long the interrogation might take and our members do not have the patience to wait any longer for a salary review,” he remarked.

Teachers were outraged when the Kenya National Union of Teachers (KNUT) signed a non-monetary CBA with TSC. The union, led by Secretary-General Collins Oyuu, began negotiations to end the standoff.

In their proposal, KUPPET requested that teachers’ commuter allowance be increased from Ksh5,000 to Ksh8,000 and that the lowest-paid teacher’s salary be increased from Ksh16,000 to Ksh20,8000.

However, the CBA has not been honored because talks with TSC have yet to begin.

If the strike is not called off, it will begin just days before the start of the Kenya Certificate of Primary Education (KCPE) and Kenya Certificate of Secondary Education (KCSE) exams.

The KCPE exams are set to begin from March 7 to 10, paving the way for the KCSE, which is set to begin on March 11.

 CBA 2021 – 2025:  The Teachers Service Commission (TSC) has responded on status of the pending teachers Collective Bargaining Agreement (CBA) planned to be signed before July 2021.

TSC responded after the Kenya Union of Post Primary Education Teachers (Kuppet) Secretary General Akello Misori wrote to Nancy Macharia expressing concern on delay in concluding talks on new CBA.

Misori said for the past two years since they began talks on the new CBA, the teachers’ employer has consistently ignored their attempts to have structured talks.

“As a union, we have diligently discharged our obligation under the Labour Relations Act, but the government has been dragging its feet for more than a year,” said Akello Misori, the Kuppet secretary general.

Kuppet says all that remains in the negotiations is for Salaries and Remuneration Commission (SRC) to give its advisory to the Commission to enable it to table a counter offer to the union.

But in response TSC said it has noted the union grievances and agree they are valid.

The Commission further assured teachers that it is taking all steps to ensure the matter is addressed in the shortest time possible.

“The Commission has duly noted your sentiments on the above subject matter (CBA 2021 – 2025) with which we concur to be valid. I wish to assure that the Commission is taking all the steps to ensure that the matter is addressed in the shortest time possible,” said TSC CEO Dr. Nancy Macharia.

In April National Treasury Cabinet Secretary Ukur Yatani wrote to the Salaries and Remuneration Commission (SRC) that his ministry will not release close to Sh83 billion in salary increment that the State owes civil servants and teachers.

In a letter dated March 18 and addressed to Anne Gitau, the Commission Secretary at SRC, Yatani attributed this to budgetary constraints due to the upcoming General Election and the adverse effects of the Covid-19 pandemic.

Teachers unions protested the decision. Through their labour unions, teachers and civil servants threatened to down their tools should the government not honour the various collective bargaining agreements (CBAs) it struck with them.

The implementation of the new CBA is supposed to begin on July 1, 2021

At least 320,000 teachers across the country are anxious as their Collective Bargaining Agreement nears its expiry date.

The current CBA will expire at the end of the month but TSC has failed to make a counter offer to the one made by teachers’ unions in the 2021-2025 CBA.

The current CBA, signed in 2017 was implemented in phases for the last four years at a cost of Sh54 billion and will expire on June 30, 2021.

CBAs are usually discussed and implemented across four years.

Ordinarily, talks for a new cycle between the teachers’ unions and TSC are done at least a year before the expiry of the existing one.

The next elections, Yatani said, will cost taxpayers a total of Sh42 billion.

“We have already factored Sh10 billion in the Financial Year 2021-22 ceilings for the preparatory activities,” said Yatani, adding that the remaining balance will be factored in the next financial year.

This combined with a drop in taxes collected, Yatani said, forced the Exchequer to set aside only Sh6.8 billion, or 10 per cent of the Sh68 billion meant for the four-year salary reviews for national government workers in the upcoming budget. This excludes county workers.

The remaining cash would be released in phases in the financial years 2022to 2023-2024 to 2025.

However, labour union leaders castigated Yatani for using elections and Covid-19 as a reason to withhold their dues.

“The Government and employers should prepare for stiff resistance from unions,” said Wilson Sossion, Kenya National Union of Teachers (Knut) Secretary General, adding that the economy was more than capable of accommodating Sh83 billion, with close to two-fifths of this earmarked for teachers.

The National Treasury has projected that it will collect Sh1.76 trillion in taxes in the financial year beginning July even as it seeks to turbo-charge an economy that has been devastated by the pandemic.

“Further, due to the negative effects of Covid-19 on the economy we expect the economy and the projected slow recovery, revenue performance over the next two years,” said Yatani.

The National Treasury had earlier stated that it expected the economy to recover this year, growing at around seven per cent compared to slower estimated growth of 0.6 per cent in 2020.

A rebound in growth will largely depend on a return in investor confidence as infection rates go down. A faster rollout of the vaccine programme is also expected to help sectors such as aviation and hotel to return to normal.

After two successive quarters in which the economy contracted, the business climate seems to have recovered in the fourth quarter of last year after President Uhuru Kenyatta eased most of the containment measures.

But the optimism that was beginning to show bloom seems to have been blunted by a third wave of infections that saw the president introduce enhanced containment measures, including putting five counties on lockdown.

Cotu Secretary General Francis Atwoli said globally economies have been devastated by the pandemic.

“But counties make annual budgets. We do not have to wait for four years to think of workers’ plight,” said Atwoli.

He said the money being borrowed should be used to support Kenyans.

“I said it that the billions we are borrowing should supplement our budgetary allocations and also fight of Covid-19. But not to be pocketed by a few individuals,” said Atwoli.

The Public Finance Management Act 2012, however, does not allow the Government to use borrowed money to pay salaries.

Sossion said excessive borrowing in the economy cannot be used to punish workers.

“The CBAs must be funded as recommended by SRC. The Treasury and government cannot undermine what has been recommended by SRC,” said the nominated MP.

Kenya Universities Staff Union (KUSU) said the Government must look for money for the workers’ CBAs or risk an industrial action.

“Kenyans pay taxes and workers are the Kenyans. So they will have to get what is due to them. The Government must look for money to implement CBAs,” said Charles Mukhwaya, KUSU Secretary General.

“Sh6 billion is a drop in the ocean and a big joke.”

Kenya Union of Post Primary Education Teachers (Kuppet) Secretary General Akelo Misori declined to comment on the matter. “No comment at the moment,” said Misori.

This comes after Kuppet held a three-day retreat in Naivasha to iron out pending issues under the present CBA and to lay ground for the next phase of the agreement.

Insiders in the union however said the move would be a major setback for classroom teachers, who were expected to largely benefit from the next CBA.

Classroom teachers were given a raw deal under the present Sh53 billion CBA as it awarded staff with supervisory roles such as head teachers and their deputies.

Union of Kenya Civil Servants Deputy Secretary General Jerry ole Kina said they are in the last phase of their CBA and noted that they have been in talks with the Government.

“We have been trying to monitor the development. We are expecting the Ministry of Public Service tomorrow (Monday). We have been in discussion. Before we can comment, let’s hear them first,” said Kina.

“If it’s a positive answer we shall welcome. If this is for entire public service then we need to know the fine details of what they are talking about.”

Atwoli took issue with the manner in which public servants’ CBAs have been structured.

CBAs, he said, should be of two-year cycles and not four years as is the present practice.

“And they have arm-twisted the unions to accept the four-year cycle, which is illegal, unconstitutionality against the ILO (International Labour Organisation) conventions,” said Atwoli.

The Cotu boss said with two years cycle the issue of general elections would not arise.

He however said for good industrial relations, the Government must call unions and employers such as the Teachers Service Commission (TSC) to a meeting for presentations and justifications for their planned actions.

“Meet all the union leaders and explain to them why they want to pay less and also allow unions to ask questions like why pay less and Kenyans are paying taxes,” said Atwoli.

TSC CAREER PROGRESSION GUIDELINES (CPGs) FOR HIGH SCHOOL TEACHERS IN KENYA

CPG is a newly introduced system which is still a great mystery to many teachers especially those who were recently recruited by the Teachers Service Commission.

Even after many employment and promotional vacancies were  advertised, teachers were still at sea for they could not  discern and determine which positions to apply for.

How to easily get a TSC promotion to the next grade

CPG has a total of 14 Grades which teachers must go through in the teaching career.

Kindly note that you can only be promoted to the next grade after serving for a minimum of 3 years in the current grade.

To qualify for promotion to the next grade, a teacher must have satisfactory rating in the performance appraisal and successfully undertaken the relevant TPD modules.

Promotion is also pegged on the availability of funds. You can therefore only apply when the grades are advertised.

Teachers should also know that in the new system, there are no interviews for one to move from one job group to another. Once you have been promoted to the next grade then your job group changes automatically.

The following are the Grades for secondary school teachers in the CPG:

1. Secondary Teacher III

This is the entry grade for secondary school teachers who are diploma holders.

2. Secondary Teacher II
This is the entry grade for secondary school teachers who are holders of Bachelors Degree in Education or it’s equivalent.
It’s also a promotion grade for holders of Diploma in Education.

 

TSC PROMOTIONAL GRADES FOR SECONDARY SCHOOL TEACHERS

3. Secondary Teacher I
4. Senior Master/Mistress IV
5. Senior Master/Mistress III
6. Senior Master/Mistress II
7. Senior Master/ Mistress I

To qualify for appointment in this grade, a teacher must have served as a Deputy principal II or Senior master I for a minimum period of three (3) years.

13. Senior Principal
To qualify for appointment to this grade, a teacher must have served as a principal or Deputy principal I for a minimum of three years.

14. Chief Principal.

It is worth noting that Head of Department (HoD) is an illegal position which is not recognised by TSC in the new CPG.
Teachers who have taken a minimum of three (3) years in job group C3 (formerly L) should apply for the advertised 6,680 Positions for Senior Master/Mistress IV and once they are successful, they will be moved to Job group C4. In other words, there will be no other advertisements for Job group M like before. The rest of the advertised posts will only benefit Deputies and principals.

In conclusion, it will now be very difficult in the new system for a teacher to become a principal. It will take at least 30 years for one to become a principal.

So if you are employed at 25 years, then the earliest you can become a principal is when you are 55 years old.
