KUPPET RELEASES LIST OF TUTORS WHO WILL NOT BENEFIT FROM THE JULY 2020 PAY RISE, ORDERS THEM TO CONTACT NEAREST KUPPET OFFICES TO FORMALIZE UNION MEMBERSHIP

It has come to the attention of KUPPET that several TSC employed teachers are likely to miss out on the July salary increment since they are currently being paid on CBA II terms.

Consequently, the union has notified school principals in all counties to inform the affected teachers to get in touch with KUPPET officials or heads to resolve the issue before July.

DEADLINE

If the affected teachers will not contact the union to formalize their union membership before June 15, 2020 they will not benefit from the salary increase which will be effected in July 2020.

“I am kindly notifying the teachers in this list that they are being paid using CBA 2 and they are likely to miss July pay increase signed between KUPPET and TSC. I am advising them to contact any union official in their branches or school heads so that we can formalize their union membership before 15th this month so that they can benefit with salary increase next month, regards.

Primary school teachers are a happy lot this time as their employer, the Teachers Service Commission, TSC announced plans to effect the promotion of over 100, 000 P1 tutors and annual salary increment for all TSC-employed teachers in Kenya.

While announcing the TSC budget for the next financial year 2020/2021, TSC Boss Dr. Nancy Macharia broke the good news. According to Dr. Macharia, Kshs 7 billion has been set aside for the promotion of 100, 000 P1 teachers and annual salary increment for teachers.

The CEO was defending her budget for the year 2020/2021 before the Parliamentary Education Committee (PEC).

2017-2021 CBA PHASE FOUR TO AFFECT TSC ANNUAL SALARY INCREMENT AS FROM JULY 2020

The Commission has already implemented three phased of the 2017-2021 Central Bargaining Agreement, CBA that greatly affects TSC annual increments for all teachers.

This CBA was a means of averting the unending teacher strikes that had adversely affected the education sector in Kenya.

However, not all teacher grades, previously referred to as job groups, benefitted from the 2017-2021 CBA.

For instance, secondary school teachers in Grade C2 formerly referred to as Job Group K who must hold a Bachelor’s Degree in Education or its equivalent from a recognized institution, holders of Diploma in Education in Grade C1 (previously referred to as Job Group H) and Primary School Teachers in Grade B5, formerly referred to as Job Group G got nothing out of the third phase of the 2017-2021 CBA in July 2019.

This means that the aforementioned categories will not get a penny from the fourth and final phase of the implementation of the 2017-2021 CBA in July 2020.

TSC SALARY INCREMENT A SIGH OF RELIEF TO TEACHERS GIVEN THE NEWLY INTRODUCED TPD MODULES

TSC annual salary increment and promotion come in handy at a time when teachers are set to start grappling with the newly introduced Teacher Professional Development modules in April. The new TPD Modules will cost Kshs 6, 000 annually.

Following the announcement by the Teachers Service Commission about the approval of Kshs 11 billion by members of parliament for the annual salary increment and promotion of TSC-employed teachers, we would like to enlighten you about how various categories of teachers will benefit from the afore-mentioned amount.

It is now crystal clear that some teachers especially those in primary schools are staring at imminent huge salary cuts after they were irregularly promoted to grades with higher salary perks during the implementation of the 2017-2021 CBA.

Fresh details have emerged shedding more light on which teachers are likely to be greatly affected by the upcoming TSC salary cuts.

According to the Commission, several primary school teachers have been earning, more than they should with some earning a salary equivalent to that of secondary school teachers.

This is very absurd and quite demotivating to high school teachers since a teacher’s salary should be pegged on the teacher’s work output, job designation, and academic qualifications.

 

 

PROMOTIONS BY PRESENTATION OF PAPERS

After a thorough analysis of data presented before the Commission in 2017 has revealed that some regular classroom P1 teachers have been earning salaries higher than their designation. Some P1 teachers are said to have been earning salaries equivalent to that of school administrators and some school administrators earning a salary equivalent to that of their counterparts in secondary schools.

There have been numerous complaints about the criteria used to promote teachers. Some tutors especially secondary school teachers in Grade C3 former L felt cheated by the system since the Commission does not advertise promotional vacancies for the grade.

This has unfortunately seen the majority of these teachers stagnate in this grade for over 15 years.

THE BIG QUESTION ON MANY TEACHERS’ MINDS IS, HOW IS THIS EVEN POSSIBLE?

The world is a funny place and full of possibilities too. According to the circular, this anomaly arose some three years back when the commission decided to promote teachers by simply presenting papers instead of following the right protocol.

 

TSC CIRCULAR ON CONFIRMATION OF INSTITUTIONAL ADMINISTRATORS

Now that the Commission is set to promote and effect salary increments of teachers on July 1, 2020, all field officers have since been directed to confirm data for all school administrators who were on duty as of June 30, 2020.

“Before the implementation of the current CBA, on 1st July 2017, you were instructed to validate the data for institutional administrators who were on duty as of 30th June 30, 2017.

The validation exercise was extended to ensure that only teachers serving as institutional administrators were converted as such on the effective date of CBA. It has been established that some of you provided inaccurate and misleading data leading to erroneous conversion…” reads part of the circular.

SENSITIVE DATA

Given the sensitivity of this matter, the TSC has since directed all county education officers to personally collect the data afresh and submit it to the TSC headquarters by June 30, 2020.

The exercise should be closely supervised and counter-signed by the regional education director in person for verification purposes.

Furthermore, schools with excess institution administrators should be earmarked so that the extra administrators can be deployed to other stations.

The Teachers Service Commission, TSC has now made it clear about its next move once it collects data on all the teachers who were irregularly promoted.

Fresh details now indicate that the affected teachers should brace for tougher times ahead since they are staring at imminent salary cuts which will be remitted to the Commission starting July 1, 2020.

These teachers have enjoyed higher salaries that they did not deserve under the 54 billion pay rise for the last three years.

WRONG DATA

According to the Commission, the data used to promote these teachers into senior management positions were not properly captured.

This prompted irregular conversions of grades leading to overpayment and irregular salary increments for some of the tutors.

The affected teachers comprise senior teachers, deputy headteachers, and headteachers who were elevated before the roll-out of the 2017-2021 CBA.

Some County Directors provided inaccurate and misleading information leading to erroneous conversions since some teachers were promoted to grades exclusively meant for school administrators.

According to the TSC Boss Dr. Macharia, some schools were overstaffed. Some schools’ staffing levels exceeded the maximum number set by the TSC staffing norms.

TSC provides a list of school heads for fresh listing

Attached to the June 3 TSC Circular on the irregular promotions was a complete list of all TSC employed teachers currently serving as school heads for fresh listing in order to weed out undeserving ones.

County directors are required to study the list carefully and identify tutors who are not correctly placed or those captured as serving administrative functions yet they are not.

“You are expected to carefully study the list and identify teachers who are not correctly placed or are not performing administrative functions yet their names appear as such in the database,” Wrote Nancy Macharia.

DEVOLVED FUNCTIONS

This comes at a time when the TSC has devolved some of its functions to county and regional offices.

In a Circular dated February 13 2020, all TSC promotions and appointments will now be conducted at the county and regional levels.

The circular contains the latest TSC guidelines on teacher promotions. According to the guidelines, the commission has devolved the appointment and consequent promotion of all school administrators save for those serving in the extra -county and national schools.

“The Commission hereby directs that the appointment and deployment of all primary and secondary school institutional administrators for County and Sub-County schools secondary schools be coordinated by the regional director,” reads part of the circular.

The circular also provides an elaborate policy on the process of appointing the afore-mentioned school administrators to ensure fairness and equity.

The new policy dictates that TSC County directors be charged with the responsibility of identifying available vacancies for school administrators and present the list to the Commission for advertisement.

Interested and qualified candidates will then apply for the positions online for the Commission to shortlist them.

The regional director will then interview the shortlisted candidates with the help of the respective TSC County directors and deploy successful candidates.

The TSC regional director of education shall be held accountable for the entire process.

DEVOLVED CORRUPTION

This news has been received with mixed reactions with some tutors thinking that this is a way of devolving corruption.

They believe that this decentralization will give regional and county directors too much power compared to when the interviews were conducted at the TSC headquarters.

According to a teacher who sought anonymity, regional directors mar simply connive with County directors to prefer some candidates over others.

In a nutshell;

Teachers affiliated to the Kenya National Union of Teachers, KNUT did not receive a penny out of the July 2020 TSC salary increments and consequent promotions for they fall under the old schemes of service, SOS instead of the Career Progression Guidelines, CPGs.

TSC Head of Communications, Ms. Beatrice Wababu has confirmed that indeed 32, 556 teachers did not receive any promotions or salary rise since they still do fall under the old schemes of service being championed by KNUT.

However, some 47, 131 teachers in grade B5 have been promoted by the Commission to the next job group, C1 using the Career Progression Guidelines, CPGs. This number includes teachers who either belong to the Kenya Union of Post-primary education Teachers, KUPPET, or non-unionized.

 

NOT QUALIFIED

To clarify the matter, Ms.Wababu said that the TSC human resource department found the teachers unfit for promotion and subsequent salary increment for they fell under the Schemes of Service.

For a long time now, the TSC has sidelined the schemes of service being propagated by the Sossion-led union KNUT. Therefore, the 32, 051teachers in B5 did not qualify for promotion toC1.

Decrying the outright discrimination of KNUT members by the Commission, KNUT secretary-general has urged the affected members to remain calm adding that the union will not be toppled.

“The illegal, discriminative, and blatant abuse of teachers’ constitutional rights is the highest form of unfair labor practice that violates all International Labour Organization, ILO conventions, standards, and treaties. The aim is to permanently kill KNUT and silence its members once and for all,” said Sossion.

THE EXODUS

Unending wrangles between KNUT and TSC have seen many teachers dump KNUT for KUPPET to get salary increments and promotions.

The promoted grade B5 teachers will now earn a basic salary between Ksh 27,195 and 33, 994 up from the initial 21, 756, and Ksh 27, 195.

TSC TPAY

Unlike in the past, teachers can now easily access their payslips online via the TSC TPAY portal.

Once logged in, teachers are at liberty to manage their third party transactions including union dues.

This has made it easy for teachers to leave unions, especially KNUT whose membership continues to shrink day by pay.

The once giant union has now been reduced to a shell and the once vibrant union leader Wilson Sossion has been reduced to a toothless dog that only barks without biting.

Some stakeholders now feel that Sossion’s leadership at KNUT is doing more harm than good especially now that the TSC has deregistered him and refused to engage him in any talks on grounds that he is no longer a teacher.

While Sossion is lamenting about the unfair treatment of KNUT members by the Commission, the TSC claims that the court ruling that reinstated the old schemes of service has made it extremely difficult for the Commission to implement the 2017-2021 collective bargaining agreement, CBA.

With 32, 000 teachers now counting their losses, all eyes are on Sossion and KNUT to see their next step. As KNUT continues to suffer blow after blow from the Commission, KUPPET is enjoying the warmth of TSC shelter.
