Persuant to its constituional mandate established under article 237 of the Kenyan constitution 2010, the Teachers Service Commission (TSC) has 13, 713 promotion vacancies for chief principals, principals, deputy principals, senior master II, headteachers, deputy head teachers and secondary teacher I to be filled between January- February 2023.

“The Teachers Service Commission is a Constitutional Commission established under article 237 of the Constitution.
One of its mandate is to appoint and deploy institutional administrators. Pursuant to this mandate, the Commission invites applications from suitably qualified teachers for the posts shown below in line with the Teachers Career Progression Guidelines.” Read the 2023 TSC promotions advert in part.”

TSC News Acting School Administrators To Be Confirmed In July Promotions

 

TSC confirmation is nigh among all the school administrators including senior teachers/masters, deputy head teachers, and school heads who have been serving in acting capacities.

This follows plans from the employer to replace retiring school administrators including 1,025 school heads whose two-year contract is elapsing by the end of July.
Eligible School Administrators serving currently in acting capacities must have at least served in the same position for at least three years.
The teachers looking forward to these imminent promotions must also have been actively involved in filling and submitting their termly Teacher Performance Appraisal Development ( TPAD) ratings.
Having issued a Circular numbered 14/2021, The teachers’ employer (TSC) spelled out that the promotions of teachers shall be as stipulated in the Career Progression Guidelines (CPG) in operation.
The teachers ‘ employer (TSC) has further spelled out that teachers serving in Arid and Semi-Arid Lands and other difficult to staff areas as administrators in acting capacities shall be promoted progressively until they acquire grades that are in tandem with their respective positions.
Teachers should note that the CBA  2021-2025 enumerated the areas below as the official ASAL And Hard to staff areas:

While congratulating TSC after signing the 2021-2025 Collective Bargaining Agreement, the Kenya National Union of Teachers (KNUT) Secretary-General, Collins Oyuu, clarified that what TSC had done is to list the hard-to-staff areas and maintained that they were putting administrators on acting capacity regardless of their grade. These teachers are to serve in these administrative ranks in the hard-to-staff areas until they attain their respective grades for eventual confirmation.
“Those areas are hardship but hard to staff, meaning, even positions of headteachers and their deputy counterparts often lack interested candidates, while those present are not qualified for those positions in terms of what we have in the CBA”, Oyuu observed.
Oyuu later added that these teachers were promoted to act in those positions because those areas were hard to staff and nobody was willing to go there. He further said that TSC was looking at the interest individual teachers had in line with serving under the acting capacity of administration in those areas until when the teacher attains the full grade of administration for full confirmation of the position the teacher was acting before.
TSC when advertising for mass recruitments of school administrators for both primary and secondary schools sometimes in September last year, required that potential candidates upload the following during the application:
  • Letter of appointment to the current grade
  • Letter of appointment to the current responsibility
  • Certificate of good conduct from the Directorate of Criminal Investigations (DCI)
  • Clearance Certificate by Higher Education Loans Board
  • Clearance application from the Ethics and Anti-Corruption Commission
  • Tax Compliance Certificate from the Kenya Revenue Authority

Prior to the latest CBA whose Implementation lapses June this year, job groups used to run from G for starting primary teachers to R for Principals.

However with the signing of the CBA came the career progression guidelines(CPGs) that replaced the former scheme of service.

According to CPGs, the former grading system changed to B5 for starting primary school teachers, C1- C5 and D1-D5 for Principals.

 

Below are the details of the new job groups and the number of years before Promotions are attained.

1). Grade B5 (T- Scale 5); Established for Primary Teacher II

2). Grade C1 (T- Scale 6); For Secondary Teacher III, Lecturer III and Primary Teacher I,To C2 for diploma teachers is automatic after 3 years

3). Grade C2 (T- Scale 7); For Secondary Teacher II, SNE Teacher II (Primary Schools), Lecturer II and Senior Teacher II

To C3 is automatic for graduate teachers after 3 years while it is through interview for diploma teachers

If a teacher join service at the age of 30 after serving Bom and later as an intern teacher for 2 years it will take a minimum of at least 9*3=27 years for a teacher whose promotion is automatic after every three years without any form of stagnation.

This teacher will be chief principal when he will be 58 years ,the age one is supposed to work from home.

With the 2021 KCPE candidate class counting 48 hours only onto the examination, candidates in Kerio Valley are a bundle of nerves not sure whether they will sit for their national tests given the alarming rate of insecurity that has forced non-resident teachers to flee the area to seek refuge elsewhere.

According to the Daily Nation this morning, a total of 30 TSC employed teachers have fled and deserted their duties following an incident that left scores of teachers dead when bandits rained bullets on a school bus that was ferrying students in February.

Area residents were also taken aback by this shocking revelation. They peered into the school bus that was shot at by bandits while carrying students of Mogil Secondary School in Marakwet East, Elgeyo Marakwet County on February 18, 2022 in disbelief.

National exams in the Kerio Valley region could therefore be jeopardised as teachers flee due to rising insecurity.

TSC List of Teachers Who Have Deserted Duty at the Contentious Kerio Valley

Verified reports indicate that more than 30 teachers in the insecurity prone area have deserted their schools.

The teachers, including heads of school, say they fear for their safety due to the incessant attacks.

Non-local teachers in schools bordering Kerio Valley are fleeing the area due to insecurity as activists urge the national government to suspend national examinations in the region.

Special 2021 KCPE and KCSE National Examinations

Human rights groups want the government to consider administering special examinations to learners in the region when normalcy returns to the region. They say this is the only way to provide a level-playing field for all the candidates.

 

Since more than 30 teachers in the insecurity prone area have deserted their schools, learning and adequate preparations for the upcoming national exams have come to a standstill.

What Happens if a TSC Teacher Deserts Duty?

Kindly note that all TSC teachers are guided by the Teachers Code of Conduct. Any teacher who violates the provisions of the Code of Regulations for Teachers and the TSC Code of Conduct and Ethics is bound to face disciplinary action which may include warning or interdiction. Therefore teachers who are fleeing Kerio Valley will have to offer an explanation through Show-Cause  Letters explaining why they have decided to desert duty.

 

TSC Disciplinary Process

 

A Head of institution may initially issue a verbal warning or caution the teacher in writing on minor breaches.

In case of persistent misbehaviour, the teacher may be required to show cause why disciplinary action should not be taken against him/her.

From the teacher’s response, the head of institution may serve the teacher with a warning or present the case before the agent.

The agent shall;

 

Investigate and assemble relevant evidence.

Invite the accused teacher in writing to defend himself/herself against specified allegation.

Call witnesses to give evidence in the presence of the accused teacher.

Allow the teacher to cross-examine each witness.

In case of desertion where teacher’s whereabouts is unknown, the agent will interdict without any delay.

After the preliminary hearing the agent may reach any of the following decisions;

 

No case to answer.

Warn the teacher administratively.

Interdict the teacher.

NB: In some cases TSC or agent can interdict a teacher without inviting him/her for preliminary hearing.

 

An interdicted teacher should write a defense statement within 21 days from the date of interdiction and provide contact address. A case will normally be heard within three months after interdiction. In case of delay the teacher is advised to make enquires.

“Look at the kind of salaries teachers earn, If someone can sacrifice part of that salary to improve his or her education it doesn’t make sense that once you complete then that very paper you toiled so hard , four years plus, to get, that it doesn’t add any value to your life,” said Suba Mp John Mbadi earlier today in Parliament.

 

Mbadi said it is unacceptable for teachers to retire with their papers they invested heavily to acquire.

 

 

 

ODM nominated Mp Wilson Sossion had filed a petition (004/2022) in Parliament thwarting TSC move to block teachers with mean C (plain) and below from promotion.

 

 

 

The petition subject : REFUSAL BY THE TEACHERS SERVICE COMMISSION TO ACKNOWLEDGE UNDERGRADUATES, GRADUATES AND POST GRADUATES QUALIFICATIONS ATTAINED BY INSERVICE TEACHERS FROM RECOGNIZED UNIVERSITIES.

 

Sossion and other Mps argue that TSC has no power to regulate entry grade to universities and colleges and so its out of order to bar teachers from promotion and employment.

 

Mbadi says their should be no other body to trash the minimum entry requirements set by universities and colleges that offer training.

 

 

 

The lawmaker says when one makes a decision to further their education they invest heavily and this cannot be taken lightly not even with TSC.

 

 

 

Mbadi wants the problem solved once and for all even if it means allocating more resources. He asked the Education Committee members to look into the matter deeply even if it means new budget allocation for teachers.

 

“If there is budget allocation that may be needed to solve this issue let it be submitted so that we can show respect to our teachers,” said Mbadi

 

Nyaribari Chache Mp, Tongi Richard, also supported the petition by Wilson Sossion saying teachers need to be respected and not punished.

 

“We would not have doctors and professionals we have in Kenya if it were not for teachers. We all fail exams at some point in time depending on circumstances at that time. If a teacher has gone back to school because he or she has realized the opportunity and value they would add to Kenyans they should not be punished rather rewarded,” said Tongi.

 

 

In December last year during the Kenya Primary School Heads Association (Kepsha) conference in Mombasa, the Commission Deputy Director of Staffing Antonia Lentoijoni said TSC wont allow teachers with grade C (plain) and below to teach in secondary schools.

 

She said teachers who did not attain a mean grade C+ in the Kenya Certificate of Secondary Education (KCSE) exam will not teach in secondary schools even if they had attained a degree later.

 

Lentoijoni added that, all secondary school teachers would only be allowed to teach subjects for which they scored a C+ and above in KCSE.

 

This is also applied with primary school teachers who would only be allowed to teach subjects they scored a C plain in their KCSE exam. She said this would improve the quality of education in Kenya.

 

 

She said the bar was raised by the Commission to improve the quality of education, following new challenges emerging in society.

 

“The Teachers Service Commission has raised the entry point of teaching in the country to have the right kind of people to offer quality education to our children,” said Lentoijoni.

 

The decision automatically locked out teachers who scored C- or C and have degrees from going to teach in secondary school, despite a suggestion by Kenya National Union of Teachers (Knut) Secretary-General Collins Oyuu that teachers in primary school be allowed to teach Grade 7 and 8 in junior secondary school because several of them have masters degrees.

 

Oyuu’s plea to TSC to allow primary school teachers with C (plain) and degrees to teach in junior secondary school was rejected.

 

Currently there are thousands of primary school teachers in TSC payroll who are suffering silently despite investing heavily to acquire higher academic papers.

 

These are primary school teachers with the following qualifications;

 

1) Diploma and Degree in Special Needs Education

 

2) Diploma and Degree in Early Childhood Development Education

 

3) Diploma and Degree in Education (Primary option)

 

4) Diploma in Education (Secondary option)

 

5) Degree in Education (Secondary option) but lacking C+ at KCSE or C+ in teaching subjects

 

The coming of Career Progression Guidelines (CPG) which ended the Schemes of Service (SoS) and the Teacher Performance Appraisal and Development (TPD) have added salt to the wounds of the teachers.

 

The teachers only receive acknowledgement letters after submitting their new certificates to the Commission.

 

Currently only promotes PTE teachers with mean grade C+ (plus) and above to teach in secondary schools.

 

The teachers must also have scored at least C+ (plus) in their teaching subjects. Once deployed the teachers start at job group C2 and later move to grade C3 after completing three years.

 

The Commission CEO Dr. Nancy Macharia said academic papers will no longer be the basis for teacher promotion. She said teacher performance is key for any meaningful promotion.

 

In July last year the Commission launched Teacher Professional Development (TPD) which it said will form part of teacher promotion.

 

Teachers are required to pay sh. 6,000 yearly for the training which takes 30 years.

 

Teacher will also be issued with a teaching license after every five years and only after successfully taking the TPD modules.

 

While in Mombasa, Lentoijoni said teachers with the qualification that TSC had approved were the right kind of people who will ensure quality education to the children.

 

“These are the people with the ability to offer quality education for our children,” she said.

 

Lentoijoni said the commission trained 28,000 teachers in the last few years to address the shortage of teachers.

 

She said Kenyan children deserved quality education and that was why the bar had to be raised by the commission.

 

Letoijoni, who thanked the government for its continued response to the shortage of teachers in the country, however, expressed happiness that at least there was some relief on the shortage of teachers.

 

She said TSC had now embarked on a new system of recruitment of teachers by first engaging those who want to be teachers as interns who were assigned to experienced teachers for mentorship.

 

“We will lobby for more money to recruit more teachers,” she said.

The Teachers Service Commission (TSC) has invited retiring school heads to sign a one and a half contract that will see their term in office extended.

Details show that some school heads who were retiring by 30th June 2021 have had their term extended on contract terms of one and a half years to two years.

However TSC did not make signing of the contract mandatory but at will. In January TSC appointed 2,111 Deputy head teachers to Head teacher position who now fall on Grade CS (TSC scale 10).

iii. have served as Deputy Head Teacher for a minimum period of three (3) years;

TSC is currently facing a crisis in schools after details emerged that at least 25,000 teachers are set to retire over two years (by 2022) and most of these are school heads. In November 2020 the Kenya Union of Post-Primary Teachers (Kuppet} revealed a report which showed that half of these tutors are above 59 years and therefore are due for retirement in June 2021.

“Our finding is that as of November 2020, the teaching service has 25,000 teachers aged 58 and above … meaning Kenya is facing a deep teacher shortage that calls for radical measures to address,” said Kuppet secretary general Akello Misori.

Now I TSC said it would require Sh17 billion to hire 12,000 teachers in 2021. “We call for urgent plans for the hiring of at least 50,000 teachers over the next one year (2021) and at least 15,000 per year between 2021 and 2026,” said Mr Misori.

The commission’s target has not been met due to inadequate budgetary provision. The Treasury allocated the TSC Sh3.2 billion for teacher recruitment in the year starting July 2021 despite a request of Sh20.2 billion thus hurting its plans of increasing teacher numbers.

In June this year the National Treasury Cabinet Secretary Ukur Yatani proposed Kshs. 2.5 billion allocation to support recruitment of additional teachers in the Financial year 2021/2022. In total the Teachers Service Commission {TSC) was awarded 281.7 billion to support its annual budget.

In June TSC released its plan on how it will employ teachers in the next three years. In the plan contained in the Programme-Based Budget 2021, TSC will employ 15,000 secondary school teachers starting this financial year. The Commission said it will employ at least 5,000 teachers annually in the next three years to curb looming crisis in secondary schools.

TSC also said it will engage the services of 5,500 interns on a one-year contract every year to plug staffing gaps in schools. However only 2,000 interns will be posted to primary schools each year. TSC has advertised a total of 3,914 replacements for primary and secondary schools to replace teachers who exited service in its July 2021 advert.

In the advert TSC said 2,987 posts will go to primary schools while 927 will go to secondary schools. TSC also advertised 5,000 teaching posts for secondary schools, however 1,000 posts will go to practicing P1 teachers who have bachelors degree with C + in KCSE and C + in the two teaching subjects.

The 1,000 successful P1 teacher applicants will be deployed to teach in high school. TSC directed qualified candidates to submit their applications online through the Commission’s website, www.tsc. go.keunder ‘Careers’ or teacheronline.tsc.go.ke not later than 12th July, 2021.
