The six primary school teachers had been promoted based on higher qualifications and duly released by TSC to serve as lecturers atMigori teachers’ training college.

Barely two years after getting deployed to the TTC, they were forced to go back to primary schools to serve as regular classroom teachers.

Feeling hurt and humiliated, the teachers filed two cases against their employer in 2018 and January 2019.

The cases were harmonized and now they are all smiles after the labor court ruled in their favor.

According to judge Onesmus Makau, the Teachers Service Commission shall compensate every teacher Sh 300, 000 for unfair demotions.

What is even more intriguing, the Commission will continue paying them salaries equivalent to those of college lecturers.

Latest Guidelines Governing TSC Promotions

Arguing its case, the Teachers Service Commission said that the teachers had been irregularly promoted and released on different dates to teach at teacher training colleges.

The Commission said it does not recognize promotions based on higher academic qualifications.

From where the Commission stands, the six: Meshack Onindo, Richard Asiago, Kenneth Ojwang’ Nelson Muogo, Nancy Anyango, and Carolyne Adhiambo ought to have remained as instructors in primary schools since attaining higher qualifications, degrees do not guarantee the teachers deployment to a higher position or deployment to a post-primary institution but only a higher pay.

Therefore, the transfers grossly offended the TSC deployment policy and other relevant guidelines and the officer who effected the irregular transfers has since been sacked.

TSC to Compensate Teachers for Unfair Demotions

Employment court Court judge Onesmus Makau ruled in their favor ordering TSC to pay every teacher Sh 300, 000 for undertaking an unfair administrative action in transferring them back to primary schools less than two years after they were promoted as lecturers.

“Even if there will be no reduction of salary, the transfer of the petitioners and claimants back to primary schools reduces their social standing as they would cease being lecturers at the TTC and that amounts to a demotion,” said Makau.

Six P1 Teachers to Continue Enjoying Salaries Equivalent to those of College Lecturers

Besides being compensated, the six primary school teachers will continue to receive salaries equivalent to those of college lecturers.

The employment and Labour Relations Court found that the rights of the six were grossly violated after TSC revoked their promotions.

They had been released to lecture at Migori TTC. However, in April 2018, the college allegedly orchestrated a campaign that saw them demoted.

They received letters transferring them back to primary schools before they completed two years yet the TSC transfer policy requires employees to serve in their new work stations for a minimum of five years before getting transferred.

The Teachers Service Commission, TSC is set to implement the last phase (four) of the July 2020-2021 Central Bargaining Agreement, CBA starting July 2020.

However, not all tutors should nurse their dreams of fatter pay slips come July since some especially those in lower grades are not included in the list of beneficiaries.

The majority of those tutors who will miss out on the July 2020 pay rise had their CBA implemented in the first two phases only (July 2017 and July 2018).

Approximately 100, 000 teachers who fall in TSC lower grades will get promoted under the new 2020/2021 TSC budget. Some of these teachers include diploma holders in secondary schools and primary school teachers who have taught for over three years in Grade B5.

Teachers in Grade B5 currently earn Kshs 24, 476. By July 1, 2020, these tutors will pocket higher salaries – Kshs 30, 595 since they will be promoted to Grade C1.

PROMOTIONS FOR THE HIGH AND MIGHTY

Despite receiving higher salary increments in the last three phases, Chief Principals who fall in the highest TSC Grade in T-Scale 15 will still reap big from the July 2020 pay rise.

This grade encompasses principals of national and extra county schools with over 1, 000 students.

These principals currently earn Kshs 121, 814-Kshs 157, 656 a month.

After the July 2020 pay rise, these teachers will earn between Kshs 131, 380, and Kshs 157, 656 per month.

Senior principals in charge of County schools with over 540 students will also reap big since they expect a salary increment of between Kshs 3, 721, and Kshs 8, 993 per month.

These heads currently earn a monthly wage of between Kshs 109, 249, and Kshs 118, 169.

In the upcoming phase, they will earn a monthly salary of between Kshs 118, 242, and 121, 890 per month effective end of July 2020.

Principals in T-Scale 13 who are in charge of sub-county and day secondary schools will also get an increment of Kshs 10, 794 per month for the lowest- paid in this category while the highest-paid will get a salary increase of Kshs 1, 837.

All teachers in this grade will earn an equalized monthly salary of Kshs 104, 644.

The Teachers Service Commission, TSC has received a backlash from teachers on social media after the Commission denounced a list containing details of all school administrators in all the 47 counties.

This is after the Commission advised tutors to ignore the lengthy document doing rounds on social media on grounds that the document did not originate from the Commission.

“A lengthy document circulating on social media and which contains names purporting to be of school administrators is fake. It has not originated from TSC. Please ignore it,” wrote the Commission on its official tweeter handle.

Responding to the TSC post, some concerned tutors are simply perplexed by the Commission’s denunciation. Some do not understand how such a lengthy document could find its way into social media platforms.

Some teachers have challenged the Commission to clean its house instead of allowing corrupt individuals to leak important information to the public only for it to disown the information a few days later.

“Who is the originator and where does that person obtain very confidential information of school heads and other administrators from?” challenged one of the teachers.

Another tutor also wondered where such confidential information such as TSC numbers, work station, names, and grades/ job groups could be obtained from. Surely, there is no way such credentials can be made up.

Other critics have also attributed the leaking of important information regarding teachers’ issues to bloggers who are in most cases correct.

They thus challenged the Commission to take charge of crucial information before it loses its grip.

“Going through the document, almost everything is real. From schools, TSC numbers to job group placements. These documents are leaked by some bloggers who are close to TSC officials at the Headquarters,” argued another.

The Commission has since been challenged to take charge and sue those responsible for exposing such confidential information before it loses its grip.

 

Marginalized Counties

According to the details contained in the fake document, some counties have got more chief principals while others have got none.

For instance, Kiambu County has got the highest number of chief principals in the country, seventeen out of the total 151.

In the second position is Homabay County with 10 followed by Nyeri which has got nine.

Isiolo, Lamu, Kwale, Marsabit, Tana River and Turkana counties on the other hand have none.

Chief principals are the highest-ranked teachers who are entrusted with the responsibility of managing national and extra county schools with over 1, 000 learners.

They earn the highest salary between Sh 111, 201, and Sh 152, 937 per month. They are set to earn an increased salary starting July 1, 2020 between Sh 121, 814, and Sh 157, 656.

When it comes to Senior Principals, the second-highest rank, Murang’ a County takes the lead with 60 followed by Kakamega(56), Kiambu(55), and Meru(53).
